This article shall be known as an "Ordinance
Creating a Local Enforcing Agency for Enforcement of the Uniform Fire
Safety Code in the Borough of Hampton, Hunterdon County, New Jersey."
The purpose of this article is to provide for
local enforcement of the Uniform Fire Safety Act[1] and the codes and regulations adopted under it (Uniform
Fire Safety Code, N.J.A.C. 5:18-4.1 et seq.).

Pursuant to Section 11 of the Uniform Fire Safety
Act (N.J.S.A. 52:27D-202), the New Jersey Uniform Fire Safety Code
shall be locally enforced in the Borough of Hampton.
The local enforcing agency shall be the Office
of the Fire Safety Code Inspector.
The Office of the Fire Safety Code Inspector,
as the local enforcement agency, shall enforce the Uniform Fire Safety
Act[1] and the codes and regulations adopted under it in all
buildings, structures and premises within the established boundaries
of the Borough of Hampton, other than owner-occupied one- and two-family
dwellings, and shall faithfully comply with the requirements of the
Uniform Fire Safety Act and the Uniform Fire Safety Code.

The local enforcing agency shall carry out the
periodic inspections of the life hazard uses required by the Uniform
Fire Safety Code on behalf of the Commissioner of Community Affairs.
The Office of the Fire Safety Code Inspector, as the local enforcing agency established by § 131-4 of this article, shall be a part of Hampton Fire Department and shall be under the direct supervision and control of the Fire Chief of the Hampton Fire Department.[1]

The Fire Safety Code Inspector shall serve for
a term of two years. Any vacancy shall be filled for the unexpired
term.
Such additional inspectors and other employees
as may be necessary in the Office of the Fire Safety Code Inspector
shall be appointed by the Hampton Borough Council upon the recommendation
of the Fire Safety Code Inspector.
Inspectors, including the Fire Safety Code Inspector
and other employees of the enforcing agency, shall be subject to removal
by the Mayor of Hampton Borough for inefficiency or misconduct. Each
inspector or employee to be so removed shall be afforded an opportunity
to be heard by the Hampton Borough Council.
Pursuant to Sections 15 and 17 of the Uniform
Fire Safety Act (N.J.S.A. 52:27D-206 and 52:27D-208), any person aggrieved
by any order of the Office of the Fire Safety Code Inspector shall
have the right to appeal to the Construction Board of Appeals of Hunterdon
County.

The Borough of Hampton adopts as its fee schedule
for inspections the permit fees established by the Uniform Fire Safety
Code.
The Fire Safety Code Inspector may recommend
to the Hampton Borough Council amendments to the Uniform Fire Safety
Code to be operative within the Borough of Hampton in accord with
Sections 11 and 22 of the Uniform Fire Safety Act (N.J.S.A. 52:27D-202
and 52:27D-213).
