A. 
No person shall erect, construct or maintain or cause to be erected, constructed or maintained any building or any appurtenance or fixture connected therewith which shall encroach upon, extend over or obstruct, in whole or in part, any street, sidewalk or other public place without the permission of the Borough Council or its authorized agent.
B. 
No person shall erect, construct or maintain or cause to be erected, constructed or maintained any window, sign, showcase, showbill, step, porch, platform, area, cellar door, covering (excepting a cloth awning having an elevation at least seven feet above the sidewalk), fence or other structure, obstruction or encroachment of any kind which shall extend over, obstruct or encroach upon any street, sidewalk or other public place without the permission of the Borough Council or its duly authorized agent.
No person shall place or maintain or cause to be placed or maintained any wares, goods or merchandise on the sidewalk or street in front of any store or other building without the permission of the Borough Council or its duly authorized agent; but this section shall not prohibit merchants from placing wares, goods or merchandise upon the sidewalk for the purpose of loading and unloading the same, provided that the free passage over such sidewalk is not obstructed and provided that the same be removed without reasonable delay.
Any building or any appurtenance or fixture connected therewith or any window, sign, showcase, showbill, step, porch, platform, area, cellar door, covering (excepting a cloth awning having an elevation of at least seven feet above the sidewalk), fence or any other structure, obstruction or encroachment of any kind which shall now or hereafter be erected or constructed or maintained or any goods, wares or merchandise placed or maintained contrary to the provisions hereof shall be forthwith removed by the person erecting, constructing or maintaining the same, upon notice, in writing, so to do, and in the event of the refusal or neglect of such person so to remove such building or other obstruction or encroachment as herein before enumerated, after notice as aforesaid, the Borough Council or its duly authorized agent may remove the same or cause it to be removed at the expense of the person so erecting, constructing or maintaining the same.[1]

Any person, firm or corporation who shall violate any of the provisions of this article shall, upon conviction, be punishable by a fine not exceeding $2,000, imprisonment for a period not exceeding 90 days and/or a period of community service not exceeding 90 days.
