The Borough Council of the Borough of Hampton
is hereby authorized to provide for the removal of snow and ice and
for the collection of garbage along private roads in the Borough if,
in the opinion of Council, the traffic along said roads warrants the
expenditure of public funds.
Any property owner or resident desiring snow
and ice removal and garbage collection shall make a written request
for the same to the Borough Council. The request shall identify the
private road or street for which services are requested and provide
the names and addresses of the property owners whose lands would be
benefited by the provision of snow and ice removal and/or garbage
collection.
The Borough Council shall consider each such
request and if, in the opinion of the Council, there is sufficient
traffic or sufficient residences along the private road to justify
the expenditure, the Borough shall adopt a resolution authorizing
snow and ice removal and/or garbage collection. The Borough Council
may provide snow and ice removal without garbage collection or garbage
collection without snow and ice removal if the circumstances so warrant.
Prior to providing snow and ice removal services
and/or garbage collection services, the owner of the private road
and the property owners along said road shall enter into an agreement
to hold the Borough of Hampton harmless for any damage to the private
road or property caused by the provision of snow and ice removal services
and/or garbage collection.
