As used in this article, the following terms shall have the meanings indicated:
CONTRACT
An arrangement for the provision of services on a regular basis. A contract does not have to be in writing unless state law requires it to be in writing.
PROOF OF COLLECTION SERVICE
A written record, log, bill or document evidencing receipt of service for the collection of solid waste for the preceding month from a person lawfully engaging in private solid waste collection services within the Township of Bloomfield.
REGULAR SOLID WASTE COLLECTION SERVICE
The scheduled pickup and removal of solid waste from residential, commercial or institutional premises located within the boundaries of the Township of Bloomfield at least once a week.
REGULAR SOLID WASTE GENERATOR
Any property owner, tenant or occupant of any single-family residential dwelling or multiple dwelling, or the owner of any commercial or institutional building or structure located within the boundaries of the Township of Bloomfield, who generates solid waste at those premises.
SOLID WASTE
Garbage, refuse and other discarded materials resulting from industrial, commercial and agricultural operations and from domestic and community activities, and shall include all other waste materials, including liquids, except for solid animal and vegetable wastes collected by swine producers licensed by the State Department of Agriculture to collect, prepare and feed such wastes to swine on their own farms.
SOLID WASTE COLLECTION
Any activity related to the pickup and transportation of solid waste from its source or location to a solid waste facility or other destination.
SOLID WASTE CONTAINER
A receptacle, container or bag suitable for the depositing of solid waste.
SOLID WASTE FACILITIES
Includes the plants, structures and other real and personal property acquired, constructed or operated or to be acquired, constructed or operated by any person pursuant to the provisions of this, or any other act, including transfer stations, incinerators, resource-recovery facilities, sanitary landfill facilities or other plants for the disposal of solid waste, and all vehicles, equipment and other real and personal property and rights therein and appurtenances necessary or useful and convenient for the collection or disposal of solid waste in a sanitary manner.

A. 
Every responsible solid waste generator within the Township of Bloomfield residing in single-family residential housing within the Township of Bloomfield, in those instances where regular solid waste collection services are not otherwise provided for by the municipal solid waste collection service, shall enter into a contract with any person lawfully providing solid waste collection services within the Township of Bloomfield.
B. 
Every responsible solid waste generator within the Township of Bloomfield that is an owner of multifamily residential housing located within the Township of Bloomfield, in those instances where regular solid waste collection services are not otherwise provided for by the municipal solid waste collection service, shall enter into a contract with any person lawfully providing solid waste collection services within the Township of Bloomfield. It shall be the responsibility of the owner of any multifamily residential housing to provide a sufficient number of appropriate waste containers for the deposit of nonrecyclable waste materials to be disposed of as said waste.
C. 
Every responsible solid waste generator within the Township of Bloomfield that is an owner of a commercial or institutional building or structure located within the Township of Bloomfield, in those instances where regular solid waste collection services are not otherwise provided for by the municipal solid waste collection service, shall enter into a contract with any person lawfully providing solid waste collection services within the Township of Bloomfield.
D. 
The provision of Subsections A and B hereof shall not apply to any responsible solid waste generator who transports the solid waste which is generated at such generator's residential premises directly to the solid waste facility utilized by the Township for disposal, provided that the responsible solid waste generator complies with the provision of § 491-13 hereof.
Each responsible solid waste generator in the Township of Bloomfield shall, within 10 days of a written request from the Township of Bloomfield, provide proof of collection services. Proof of collection is to be submitted to the Township Clerk.

Within six months after the effective date of this chapter and at least once every six months thereafter, the Township Clerk shall cause a notice to be published in one official newspaper of the Township, stating the requirements which this chapter imposes upon responsible solid waste generators. The Clerk shall cause such other notice to be given, if any, as the Township Council may deem necessary and appropriate. A failure to give any notice required by this section shall not relieve a responsible solid waste generator of its obligations under this article and shall not be grounds for any claim by such generator.

Any person who, not less than 20 days after the receipt of the notice of noncompliance, violates or falls to comply with the provision of this chapter shall, upon conviction, be subject to the following violations and penalties:
A. 
First offense: a fine of $1,000 or imprisonment for a term not exceeding 90 days or a period of community service not exceeding 90 days, or by any combination of such fine, imprisonment and/or community service.
B. 
Second offense: a fine of $2,000 or imprisonment for a term not exceeding 90 days or a period of community service not exceeding 90 days, or by any combination of such fine, imprisonment and/or community service.
C. 
Each offense thereafter: a fine of $2,000 and imprisonment for a term not exceeding 90 days or a period of community service not exceeding 90 days.
