A.
Authority. The Chief of Police is the chief executive
of the Department and shall exercise authority in all matters of operations
and discipline, except as otherwise set forth herein.
B.
Responsibilities. The Chief of Police is responsible
for supervising the enforcement of all laws and ordinances within
the legal jurisdiction of the Law Enforcement Department of the Township
of Toms River; for planning, directing, coordinating, controlling
and staffing all activities of the Department; for its continued and
efficient operation; for the enforcement of its rules and regulations;
for the completion and forwarding of such reports as may be required
by competent authority; and for its relations with the public, the
Mayor, the Township Council and other governmental agencies.
C.
Duties. The Chief of Police shall be the head of the
police force and he shall be directly responsible to the Business
Administrator for the efficiency and routine day-to-day operations
of the Law Enforcement Department. Pursuant to policies established
by the Business Administrator, the Chief of Police shall:
(1)
Administer and enforce the rules and regulations of
the Law Enforcement Department and any special emergency directive
for the disposition and discipline of the Department and its members
and officers;
(2)
Have, exercise and discharge the functions, powers
and duties of the Law Enforcement Department;
(3)
Prescribe the duties and assignments of all members
and officers;
(4)
Delegate such authority as may be deemed necessary
for the efficient operation of the Law Enforcement Department to be
exercised under the Chief's direction and control; and
(5)
Report at least monthly to the Township Council in
such form as shall be prescribed on the operation of the Law Enforcement
Department during the preceding month and make such other reports
as may be requested by the Township Council.

A.
Officers who have achieved the rank of Captain of Police may be promoted
by the Chief of Police to serve in the capacity of Deputy Chief of
Police.
B.
To be eligible to serve as Deputy Chief of Police, a Captain must
possess the following qualifications prior to designation:
(1)
One year of continuous service as a Captain in the Toms River Police
Department, inclusive of the probationary period.

(2)
A master's degree from an accredited college/university or equivalent
cumulative graduate-level credits, coursework, or practical experience.
(3)
Successful completion of an advanced law enforcement management program
as approved by the Chief of Police.
C.
This designation is not subject to a probationary period.
D.
The Deputy Chief(s) of Police shall perform those duties assigned
by the Chief of Police.
E.
The Deputy Chief of Police shall perform the functions of Chief of
Police in the event the Chief is absent, incapacitated, or unavailable.
If more than one Deputy Chief has been designated, the Chief, with
the approval of the Business Administrator, shall establish an order
of succession.
F.
In the event of a vacancy in the office of Chief of Police, the Deputy
Chief of Police shall serve as Acting Chief of Police until a successor
is confirmed. If more than one Deputy Chief has been designated, the
Mayor shall determine which of them shall serve as Acting Chief until
a successor is confirmed.
G.
The designation of a Deputy Chief of Police does not create an opening
or vacancy in the rank of Captain and therefore no promotion to that
rank is permitted while a Deputy Chief remains employed by the Department.
Ranking officers' authority, responsibilities
and duties within the Department shall be set forth in rules and regulations
promulgated by the Chief of Police and approved by the Business Administrator
in his or her capacity as appropriate authority as hereinafter provided.
