A. 
A driver shall be clean and neat in dress and person.
B. 
A driver shall not smoke while carrying a passenger if the passenger so requests.
C. 
A driver shall not operate a taxicab while his or her driving ability is impaired by either alcohol or drugs.
D. 
A driver shall not operate a taxicab for more than 12 hours in any continuous twenty-four-hour period.
E. 
A driver shall, at all times, cooperate with all law enforcement officers, including but not limited to giving, upon request, his or her name and taxicab driver's license number and exhibiting his or her rate card, trip record and other documents required to be in his or her possession.
F. 
A driver shall operate his or her taxicab at all times in full compliance with all New Jersey State and Toms River Township traffic laws, rules and regulations.
G. 
A radio shall be turned on or off at the request of a passenger. Program selection shall be the passenger's privilege. Whether or not a taxicab is hired, a radio shall be played at normal volume only, and all noise ordinances shall be complied with.
H. 
An air-conditioning device in a taxicab shall be turned on or off at the request of a passenger.
I. 
A driver shall not, in the course of operating a taxicab, commit or attempt to commit, alone or in concert with another, any act of fraud, misrepresentation or larceny or perform any willful act of omission or commission which is against the best interests of the public, even though not specifically mentioned in these rules.
J. 
A driver shall not apply for or accept more than one taxicab driver's license or license number.
K. 
A driver shall not permit any other person to use the driver's taxicab driver's license while operating any taxicab.
L. 
A driver at no time shall permit the taxicab to be operated for hire by another person who is not currently licensed by the Township as a taxicab driver.
M. 
During the work shift period, a driver shall not allow any person to operate the taxicab or occupy the driver's seat, except in the event of an emergency.
N. 
A driver shall not use or permit any other person to use his or her taxicab for any unlawful purpose.
O. 
A driver shall not conceal any evidence of crime nor voluntarily aid violators to escape arrest.
P. 
A driver shall report immediately to the police any attempt to use his or her taxicab to commit a crime or escape from the scene of a crime.
Q. 
A driver shall remove all currency or other valuables from the taxicab's interior prior to its examination by any authorized personnel of the Township of Toms River.
R. 
A driver shall not use a taxicab to participate in any procession or parade, other than a funeral procession.
S. 
A driver shall immediately notify the Township of his or her conviction of a crime or violation. Such notification shall be in writing and must be accompanied by a certified copy of the certificate of disposition issued by the clerk of the court.
T. 
A driver convicted of a felony or indictable matter shall immediately surrender his or her taxicab driver's license to the Township Clerk. Upon surrender of the license, the Township Council shall determine whether or not the taxicab driver's license shall be revoked because of such conviction.
A. 
A driver shall not permit more passengers to ride in any taxicab above the seating capacity of said taxicab. In addition, all seats shall be equipped with adequate seat belt restraint. All children must be seated in a separate designated seat with appropriate restraints in accordance with § 457-40 of this chapter and not in the lap of another passenger.[1]

B. 
A handicapped passenger or prospective passenger, unable to enter or ride in the rear passenger part of the taxicab must be permitted, if it is possible, to occupy the front seat alongside the driver. If a passenger's luggage occupies the rear passenger part of the taxicab, a passenger, if it is necessary and possible, must be permitted to occupy the front seat alongside the driver.
C. 
A driver shall be courteous to passengers and shall comply with all the reasonable requests of a passenger, including but not limited to giving, upon request, his or her name, his or her taxicab driver's license number and the taxicab number.
D. 
A driver shall not threaten, harass or abuse any passenger or any governmental representative, public servant or other person in the course of operating his or her taxicab.
E. 
A driver shall solicit a prospective passenger only from the driver's seat and only with the words "taxi" or "cab" or "taxicab."
F. 
A driver may not use another person to solicit a prospective passenger, nor suggest to a passenger that an additional person be accepted as a passenger.
G. 
A driver shall not pick up additional passengers, except if the passenger who hired the taxicab requests that the driver do so.
H. 
A driver may not, in omnibus fashion, pick up passengers at one or more locations.
I. 
A driver shall not seek to ascertain the destination of a prospective passenger before such prospective passenger is seated in the taxicab. A driver shall not refuse, by words, gestures or any other means, without justifiable grounds, to take any passenger or prospective passenger to any destination within the Township; this includes a person who is handicapped and any guide dog accompanying such person.
J. 
Justifiable grounds for the conduct otherwise prohibited by Subsection I shall be the following:
(1) 
Another passenger is already seated in the taxicab.
(2) 
A hail from another prospective passenger has already been acknowledged by the driver and that other prospective passenger is being picked up or is about to be picked up.
(3) 
A radio dispatched call has been accepted by the driver and he or she has displayed or illuminated the "On Radio Call" sign and has made the appropriate entry of the trip record.
(4) 
The passenger or prospective passenger is carrying or is in possession of any article, package, case or container which the driver may reasonably believe will cause damage to the interior of the taxicab, impair its efficient operation or cause it to become stained or foul smelling.
(5) 
The driver is ending his or her work shift and has already illuminated the "Off Duty" sign, locked both rear doors, and has indicated on the trip record that he or she is off duty and proceeding to his or her garage or home.
(6) 
It is necessary to take the taxicab out of service for one of the reasons given within, and the driver has already illuminated the "Off Duty" sign, made the appropriate trip record entry and locked both rear doors.
(7) 
The passenger or prospective passenger is escorting or accompanied by an animal which is not properly or adequately secured in a kennel case or other suitable container. This provision shall not apply to a Seeing Eye dog or a guide dog for the hard of hearing.
(8) 
The passenger or prospective passenger is disorderly.

K. 
A driver shall not induce the hire of his or her taxicab by giving misleading information, including but not limited to the times of arrival and departure of transportation facilities, the location of a building or place or the distance between two points.
L. 
A driver shall not refuse to transport a passenger's luggage, wheelchairs, crutches, guide dog or other property. Upon request of a passenger, the driver shall load or unload such luggage in or from the taxicab's interior or truck compartment and shall secure such compartment.
M. 
A driver shall not transport for hire any property, except blood or vital human organs, unless such property is in the possession of a passenger.
N. 
A driver shall not sell, advertise or recommend any service or merchandise to any passenger without prior written Township approval.
O. 
A driver shall comply with any request of a passenger during the trip to change his or her destination or terminate the trip, unless it is impossible or unsafe for the driver to comply with such request.
P. 
A driver shall take a passenger to his or her destination by the shortest reasonable route, unless the passenger requests a different route, and the driver shall comply with all reasonable and lawful routing requests of the passenger.
Q. 
A driver shall not collect or attempt to collect separate fares from individual passengers who have shared a taxicab for part or all of a trip, unless such fares are specifically authorized as part of a group riding program established by the Township.
R. 
A driver shall be required to accept United States currency.
S. 
A driver shall give the correct change to a passenger who has paid the fare.
T. 
A driver shall give a passenger a receipt for payment of the fare when requested to do so by the passenger. Such a receipt shall state the date, time, cab number, fare paid, extras and the Township Clerk's office telephone number.
U. 
A driver must always be capable of making change for a ten-dollar bill.
V. 
A driver shall not ask a passenger for a tip nor indicate that a tip is expected or required.
W. 
A driver shall inspect the interior of the taxicab immediately after termination of each trip. Any property found shall be taken without delay to the Toms River Township Police Department. A driver shall promptly inform the Township Clerk of the details regarding the found property.
A. 
A driver shall answer and comply as directed with all questions, communications, directives and summonses from the Township and its representatives. A driver shall produce his or her taxicab driver's license and driver's license, trip records or other documents whenever the Township requires him or her to do so.
B. 
A driver shall not knowingly operate a vehicle for hire unless such vehicle is properly licensed by the Township of Toms River.
C. 
A driver shall comply with all restrictions endorsed by the Township upon his or her taxicab driver's license.
D. 
A driver shall not operate a taxicab in the Township of Toms River while his or her taxicab driver's license is revoked, suspended or expired.
E. 
A driver shall not operate a taxicab without a valid New Jersey State license or a valid license of similar class of the state of which he or she is a resident. The taxicab driver's license shall be and remain suspended until a valid license is produced.
F. 
A driver shall immediately surrender his or her taxicab driver's license to the Township upon the suspension or revocation of his or her driver's license.
G. 
A driver shall carry a valid driver's license on his or her person while on duty and operating the taxicab.
H. 
A driver shall safeguard his or her taxicab driver's license at all times and shall, within 72 hours, exclusive of weekends and holidays, notify the Township in writing of the loss or theft of his or her taxicab driver's license.
I. 
A driver shall not alter, deface, mutilate or obliterate any portion of his or her taxicab driver's license or the attached photograph so as to make it unreadable or unrecognizable.
J. 
A driver shall not use, but shall immediately surrender for replacement and reissue, any unreadable or unrecognizable taxicab driver's license.
K. 
A driver shall submit four new photographs to the Township whenever his or her physical appearance has changed.
L. 
Within seven days, exclusive of weekends and holidays, a driver shall report any change of address to the Township, either in person or by registered or certified mail, return receipt requested.
M. 
A driver, while operating a taxicab, shall not carry a weapon without the Township's written authorization.
A. 
A driver shall keep a trip record in the taxicab and make all entries legibly in ink, as follows:
(1) 
The taxicab's medallion number.
(2) 
His or her name and taxicab driver's license number.
(3) 
The license plate number.
(4) 
At the start of each trip, the date, starting time, specific location and the number of passengers.
(5) 
On completion of each trip, the destination, the time and the amount of fare.
(6) 
All other entries required by these rules.
B. 
A driver shall not make erasures or obliterations on a trip record. If a wrong entry is made, it shall be corrected by the driver only by drawing a single line through the incorrect entry. Black lines between entries are prohibited.
C. 
A driver shall not rewrite a trip record either in whole or in part; any such rewriting shall give rise to a rebuttable presumption of an act of fraud, deceit or misrepresentation by the driver.
D. 
A driver shall not operate a taxicab unless the following are present in the taxicab:
(1) 
The trip record also known as a "trip sheet."
(2) 
His or her taxicab driver's license in the appropriate frame on the right side of the dashboard.
(3) 
The rate card assigned to the taxicab, bearing the taxi car number, in the frame on the right side of the dashboard alongside the frame for his or her taxicab driver's license.
(4) 
A Township of Toms River indexed street map.
(5) 
Receipts for passengers.
(6) 
A "Notice to Passengers" sign.
(7) 
A "Reminder - Take your property" sign.
(8) 
A "Relief Time" sign.
E. 
A driver shall not obstruct a passenger's view of any of the items required in a taxicab by these rules.
F. 
A driver shall not operate a taxicab after sunset unless all of the following items are illuminated so that they are clearly visible from the rear seat by a passenger with normal vision:
(1) 
His or her taxicab driver's license.
(2) 
The rate card.
G. 
A driver shall not operate a taxicab having any equipment, devices or signs not specifically enumerated in these rules, unless authorized in writing by the Township of Toms River.
H. 
A driver shall not operate a taxicab without continuing personal inspection and reasonable determination that all equipment, inclusive of brakes, tires, lights and signals, is in good working order and that the interior and exterior of the taxicab is clean.
I. 
A driver shall not operate a taxicab unless both he or she and either the owner or his or her agent shall, at the beginning of each work shift, sign and certify on the trip record that the taxicab and its equipment are in good working condition, that the items required in the taxicab are present, and that the cab is clean. One entry for an owner/driver is sufficient.
J. 
When a taxicab taken out of service for repair has been repaired, if the repairs were made by the driver, he or she shall immediately make a trip record entry showing the work that was done by an independent repair shop, a responsible person at the shop or the driver, shall immediately make a trip record entry showing the work that was done, the shop name and the time the work was finished. The driver shall carry the work order or any receipt with him or her while on his or her work shift and deliver it to the owner at the end thereof.
K. 
A driver, during his or her work shift, shall keep the taxicab's exterior and interior clean and shall keep clean and free from obstruction the medallion number on the trunk lid in three-inch letters, visible from the rear.
L. 
A driver, while on duty, shall not lock either of the rear doors, except at a passenger's request or with his or her consent or for a reason as specified in these rules.
M. 
While parked, the driver shall comply with the Air Pollution Control Code of the State of New Jersey and shall not cause or permit the engine of his or her taxicab to idle for longer than three minutes.
