No person, persons, firm or corporation, as
principal, agent or employee, shall keep, raise or maintain, or permit
to be kept, raised or maintained, at or upon any premises owned, controlled
or occupied by him, them or it, in the Township of Toms River aforesaid,
any swine more than 10 in number without first having procured from
the Board of Health of the Township of Toms River a permit for that
purpose. Any such permit may be revoked at any time by the Board of
Health when such revocation shall appear to said Board of Health to
be necessary for the public health and safety or upon the refusal
to comply with the provisions of this article. No permit shall allow
the holder thereof to have, keep, raise and maintain on any premises
mentioned in such permit more than 100 swine. No fee or charge shall
be made for any such permit.
All buildings, yards, enclosures or premises
in which any swine shall be kept, raised or maintained shall at all
times be kept in a sanitary condition. The failure or refusal to keep
said buildings, yards, enclosures or premises in a sanitary condition
shall be the proper basis for revocation of any permit.
No permit provided for herein shall be issued
unless prior thereto the premises on which swine are proposed to be
kept shall be enclosed with a substantially built fence to restrain
and confine said swine to said premises, and shall provide proper
shelter or shelters for swine.
Application for a permit hereunder shall be
made to the Secretary of the Board of Health in writing, and such
application shall state the location of the premises on which said
swine are proposed to be kept, the name and address of the owner and
operator of the said premises, the number of swine proposed to be
kept on said premises pursuant to said permit. No permit shall be
issued for a longer period than one year.
Nothing in this article shall apply to, affect
or cover the keeping or maintaining of pigs of less than two months
of age.
Nothing in this article shall affect or cover
the premises where fewer than 10 swine are kept and maintained.
No garbage or decaying vegetable matter, decaying
flesh of any animal, fowl or fish shall be imported into Toms River
Township for any purpose in connection with the raising or feeding
swine.
Any person, persons, firm or corporation who
shall violate any of the provisions and regulations of this article,
upon conviction for the first offense, shall pay a penalty of not
more than $100, the amount thereof being in the discretion of the
Magistrate before whom such conviction is had. For the second and
each subsequent offense, such person upon conviction shall suffer
a penalty of not more than $100 and confinement of not more than 30
days in the common jail of the County of Ocean, in the discretion
of the Magistrate before whom such conviction is bad.
