As used in this article, the following terms
shall have the meanings indicated:
Beer and wine. All other alcoholic beverages are expressly
prohibited.
Includes all public parks, playgrounds, recreation areas
and other facilities within the Town and under ownership of the Town
or under control and supervision of the Town Board or Recreation Commission.

There shall be no consumption of alcoholic beverages
in Brooks Lake Park, except in strict accordance with the provisions
of this article.
A.
If any group, organization or association wishes to
hold a function or event at any one of the town parks or recreation
areas at which it is proposed that alcoholic beverages can be consumed,
such organization must first submit to the Town Board at least 30
days prior to the scheduled event a written application for a permit
which must contain among other things the following:
(1)
The location, date and time of the proposed activity
indicating both starting and closing times.
(2)
The name, address and telephone number of the organization
filing the application and the responsible party in such organization.
(3)
The alcoholic beverage proposed to be offered for
consumption.
(4)
Written assurance by the organization and the responsible
party personally that all of the provisions of this article will be
strictly complied with in the event a permit is issued.
B.
Such application shall be considered by the Town Board
at its meeting next scheduled following the filing of the application.
The Town Board may approve such application, reject such application
or approve such application upon such terms and conditions as it shall
deem desirable and appropriate and the decision of the Town Board
shall be forthwith transmitted to the applicant.
A.
No alcoholic beverages may be consumed by any person
under the age of 21 years at any park or recreation area owned, operated
or maintained by the town.
B.
There shall be no sale of any alcoholic beverage in
any park or recreation area owned, operated or maintained by the town
unless the terms and conditions of such sale have been fully set forth
in the application to the Town Board and provided the vendor is duly
licensed to make such sales by the New York State Liquor Authority.
C.
All trash and rubbish, including but not limited to
empty bottles or cans shall be removed from the premises in which
the event occurs for which a permit is given pursuant to this article.

Any person, firm or corporation who shall violate
any of the provisions of this article shall, upon conviction, be punishable
by a fine of not more than $250 or imprisonment for not more than
15 days, or both. Each day of continuance of an offense shall be considered
a separate offense.
