As used in this chapter, the following terms shall have the meanings
indicated:
Are mechanisms designed to detect smoke and to actuate an audible
alarm. Said devices shall provide an indication that an alarm is energized
and shall be reasonably free from false alarms. Said devices may be either
battery operated, plug in or wired directly. Each such device shall be of
a model and type approved by Underwriters' Laboratory, Inc., or the Factory
Mutual Testing Laboratories.
A.
At least one single station smoke detecting alarm device
shall be provided adjacent to sleeping quarters in each residential rental
unit, whether apartment, tenement, mobile home, motel, hotel or trailer or
any other residential rental facility.
B.
Said device shall be installed in a location in accordance
with the National Fire Protection Association (NFPA) Code 101, § 11-3.3.3.
C.
Responsibility.
(1)
It shall be the responsibility of the owner of the premises
to install such smoke detector(s) in accordance with the chapter and the NFPA
Code and to maintain such smoke detector.
(2)
It shall be the responsibility of the tenant(s) to maintain
such smoke detector and to notify the landlord in writing if replacement is
required. Tenants of hotel rooms and motel rooms shall have no obligation
to maintain the smoke detectors.
D.
Authority is hereby delegated to the Code Enforcement
Officer, in cooperation with fire inspectors (if any), to assure compliance
with the terms of this chapter.
E.
Battery power shall be permitted only if the detection
device is equipped with an audible alarm to indicate low voltage in the battery.
F.
There shall be a minimum of one detector for each habitable
level of the dwelling unit.
The Town Clerk of the Town of Highlands is authorized to publish a copy
of this chapter in the Code of the Town of Highlands.
