Fees for the municipal collection of solid waste may be established by resolution of the Town Board. Such fees may be changed at any time and from time to time by resolution of the Town Board whenever, in the opinion of the Town Board, such change is in the best interest of the Town.
Late fees for unpaid municipal solid waste collection fees shall be established by resolution of the Town Board. Such late fees may be changed at any time and from time to time by resolution of the Town Board whenever, in the opinion of the Town Board, such change is in the best interest of the Town.
The Supervisor may order the suspension or discontinuance of a dumpster user's municipal collection service when, after due notice, the dumpster user has not paid fees or late fees upon direct billing by the Town. Upon suspension or discontinuance of municipal collection service for nonpayment of dumpster user fees, the dumpster user must establish to the satisfaction of the Supervisor that a licensed trash and recyclable collector will service the user at a frequency determined by the Town to be consistent with public health requirements. Failure to provide for adequate collection and disposal services or to provide satisfactory proof to the Supervisor shall constitute a violation subject to the penalties set forth in § 160-18. Any substantial accumulation of refuse or waste is hereby declared to be a sanitary health hazard and a public nuisance. The Supervisor shall have the authority to abate any sanitary health hazard or public nuisance and to impose fees, charges and penalties established by the Town Board from time to time as well as the cost of disposal for such abatement.
As an alternative to or in addition to above suspension and discontinuance remedies and penalties, the Supervisor may, at his or her discretion, direct Town employees or Town contractors to collect and to dispose of the refuse of a dumpster user who has failed to establish to the satisfaction of the Supervisor that a licensed trash/recyclable collector will service the user at a frequency determined by the Town to be consistent with public health requirements, or any other refuse which has been improperly prepared, stored or disposed of as required by the provisions and standards of this chapter or the Code. The Town Board shall have the right to establish appropriate fees and late fees for such services. The Town shall promptly bill the owner for such services.
Unpaid fees and late fees for municipal solid waste collection in arrears as of 30 days prior to the last date prescribed by law for the annexation of the warrant to the assessment roll may be included with the annual tax levy, together with any interest or penalties thereon.
A violation of this article is punishable by a fine of not more than $500 or imprisonment not to exceed 15 days, or both.
