As used in this article, the following terms shall have the meanings ascribed to them:
CITY PARKS
Includes the following:
A. 
Brotherhood Park, 25th Street and 6th Avenue.
B. 
Clinton Park, Clinton Street and 8th Avenue.
C. 
Pershing Green, 4th Street and 2nd Avenue.
D. 
Seventh Street Park, 7th Street and 1st Avenue.
E. 
Red's Field, 8th Street and 4th Avenue and Eighth Street Basketball Court, 8th Street and 3rd Avenue.
F. 
Elks Park, 6th Street and 3rd Avenue.
G. 
T/Sgt. Peter J. Dalessandro Veterans Memorial Park, 16th Street and 2nd Avenue.

H. 
Veteran's Recreational Facility, 13th Street and 2nd Avenue.
I. 
Hudson Shores Park.
RESIDENT
A person who resides within the City.
It shall be unlawful for any person to gain entrance to or be within the City Parks and the facilities therein contained unless the person shall be a resident of the City.
A. 
Each resident entering the Watervliet City parks shall be required to identify himself or herself as a City resident by use of an official identification card which may be obtained from the City Clerk or any other such person duly authorized and appointed by the General Manager.
B. 
The General Manager is authorized to provide for the obtaining and securing of said official identification cards by the residents of the City and to provide for the application therefor.

The use of any City park shall be subject to any rules and regulations for the safe, proper, and efficient operation of any park or parks as the Director of Parks and Recreation may promulgate. Any such rules and regulations shall be posted, where applicable, in a conspicuous place.

A. 
All persons shall so comport themselves as to enjoy the park without detracting or restricting the enjoyment by others also legally entitled to be there. Rowdy and boisterous behavior may be cause for expulsion from any park.
B. 
No person shall fail, neglect or refuse to comply with or obey the lawful direction or command of any member of the Watervliet Police Department, personnel of the Parks and Recreation Department or other duly authorized personnel or fail, neglect or refuse to comply with or obey an instruction, direction, regulation, warning or prohibition written, printed or displayed in any park or other recreational facility.
C. 
No parents, guardians or custodians of any minor child shall permit or allow him or her, as the case may be, to do any act which would constitute a violation of this article.
D. 
No person shall feed geese, swans, ducks or any other bird species within any park in the City of Watervliet.

A. 
The City will not be responsible for loss, damage or theft to cars and their contents nor to private property. Such loss, whether inside of buildings or on the grounds of any City park, shall be the patron's responsibility.
B. 
Lost articles or money which are found shall be turned over to the park personnel or the Police Department. A record will be kept of the receipt of and disposition of such articles. If the lawful owner of any article or money does not claim the same within a period of 60 days, the article or money shall be returned to the finder and an appropriate receipt retained by the receiving City official.

A. 
All trash is to be deposited in trash containers where available.
B. 
Where containers are not available, trash is to be removed from the parks by those who brought the material in.
C. 
No person shall do any of the following within any park: spit; discharge household refuse in litter receptacles; leave glass, cans or broken crockery or any material with sharp projections or edges in any place where it creates danger to others; discharge litter, garbage, glass, cans, oil, dye, chemicals or other objects or substances upon park grounds or into park waters.

No person shall deface, injure, displace, remove, fill in, raise, destroy or tamper with any drive, path or walk; take up, remove or carry away trees, shrubs, turf or any material or substance; or remove or destroy any structure, building or appurtenances connected with any park or any other property or equipment, real or personal, owned by the City of Watervliet or under the jurisdiction of the City Council.

A. 
No person shall use park property for business or professional purposes involving sale of any goods or the rendering of any service for a fee or for the purpose of soliciting alms or contributions unless authorized to do so by the Parks and Recreation Department.[1]

B. 
No person shall post, distribute, case or leave about any bills, placards, tickets, handbills, circulars or advertisements or any other matter for advertising purposes.[2]

A. 
Horses and other animals may not be ridden in the parks or allowed to browse or graze in any park.
B. 
Dogs, cats and other pets are not allowed in any city parks except as follows:

(1) 
Dogs are allowed in Hudson Shores Park with the condition that they be on a leash and under the supervision and direct control of the owner or handler.
(2) 
Dogs are allowed in Clinton Park in accordance with Article IV of this chapter.
C. 
No person shall allow any animal in his or her custody to discharge fecal matter in any park.
D. 
The prohibition of animals in all City parks does not apply to individuals who require the assistance of trained service animals because of disability or illness.

No person shall drink or possess beer, wine, ale or any other alcoholic beverages or intoxicating substances in any City park at any time, except at the Hudson Shores Park Pavilion when authorized to do so by the Parks and Recreation Department.

No person shall kindle, build, maintain or use a fire within the confines of any park except in devices designed for that purpose. No person shall remove any grill placed in a park by the City from the location where placed by the City to any other location within or without the park. No fuel may be used for any fire in any park grill except charcoal or sterno.

No person shall tent, camp or erect or maintain a tent, lean-to, shelter or camp in any park.

A. 
No audio equipment of any nature shall be operated within City parks, pavilions or park sites in such a manner as to interfere with the use and enjoyment of those facilities by others.
B. 
No musical equipment of any nature is allowed in City parks, pavilions or park sites unless authorized by the Parks and Recreation Department.

A. 
The General Manger and the Parks and Recreation Department are empowered to adopt such additional rules and regulations governing the use of any and all City parks, as may be deemed necessary, in the interest of public health, safety and welfare.
B. 
Any such rules and regulations shall be filed in the office of the City Clerk and made available for public inspection.

The enforcement of this article and any rules and regulations promulgated pursuant thereto will be by the Watervliet Police Department, by the Parks and Recreation Department, Code Enforcement Department, and such persons as may be, from time to time, so authorized by the City Council of the City of Watervliet.

Any person who shall violate the provisions of this article shall be guilty of a violation and shall be subject to a penalty as set forth in Chapter 1, General Provisions, Article III, General Penalty.
