A.
Before any Use Group R-3 structure is sold, leased or rented or made
subject to a change of occupancy for residential purposes, the owner
shall obtain a certificate of smoke detector, carbon monoxide and
fire extinguisher (CSACMAPFEC) evidencing compliance with N.J.A.C.
5:70-4.19 and 5:70-2.3, from the Linwood Bureau of Fire Prevention.
B.
The request for a smoke detector inspection must be
made at least 15 working days prior to settlement.
D.
The smoke detectors required in Subsection C(1) and (2) above shall be located in accordance with NFPA 72 listed in N.J.A.C. 5:70-Appendix 3A, incorporated herein by reference, and maintained in working order. The detectors shall not be required to be interconnected. Smoke detectors may be battery powered and shall be listed in accordance with ANSI/UL 217 listed in N.J.A.C. 5:70-Appendix 3A, incorporated herein by reference. Alternating-current-powered smoke detectors shall be accepted as meeting the requirements of this chapter. Use Group R-3 (one- and two-family dwellings) that were required to have alternating-current-powered smoke detectors shall be in working order, and should additional smoke detectors be required they may be battery operated.
E.
Multiple dwellings. Each living area shall be inspected
as a separate dwelling and shall be billed separately.
A.
No residential dwelling unit shall be sold or rented
and no structural change or repair of a value in excess of $2,000
shall be made thereto unless and until the structure has installed
therein an approved fire/smoke detection system which has been approved
by the Fire Subcode Official of the Linwood Building Department.
B.
Whenever a change in residence or ownership occurs in a residential
one- and two-owner occupied dwelling shall request a (CSACMAPFEC)
form from the Fire Official, the owner of the property is required
to install an approved smoke detection system, carbon monoxide detectors
and a 2A10:BC fire extinguisher under 10 pounds; must be tagged within
30 days from change of occupancy.
C.
N.J.A.C. 5:70-4.19: Single station battery operated smoke detectors
must be replaced with ten-year sealed battery powered smoke detectors
effective date: January 1, 2019.
It shall be the responsibility of the homeowner to maintain,
in operable condition, said smoke and carbon monoxide detection systems
and fire extinguisher installed as required pursuant to this chapter.
The application fee for a certificate of smoke detector, carbon
monoxide detector and fire extinguisher compliance (CSACMAPFEC), as
required by N.J.A.C. 5:70-2.3 and 5:70-4.19, shall be based upon the
amount of time remaining before the change of occupant is expected,
as follows:
A.
Requests for a CSACMAPFEC received more than 10 business
days prior to the change of occupancy: $45;
B.
Requests for a CSACMAPFEC received four to 10 business
days prior to the change of occupancy: $90; and
C.
Requests for a CSACMAPFEC received fewer than four
business days prior to the change of occupant: $161.
D.
Should
a subsequent visit be required to satisfy the CSACMAPFEC compliance,
the fee for this visit is the same amount as the original fee.
E.
All businesses
shall be registered with the Linwood Bureau of Fire Prevention annually
based on the following fee schedule:

Any owner of a building or structure who fails
to comply with the provisions of this chapter shall be fined as provided
in the Uniform Fire Code.
Whenever the Fire Official of the Linwood Bureau
of Fire Prevention shall disapprove an applicant or refuse to grant
a certificate of compliance applied for or when it is claimed that
the provisions of the code do not apply or that the true intent and
meaning of the code have been misconstrued or wrongly interpreted,
the applicant may appeal from the decision of the Fire Official to
the Atlantic County Construction Board of Appeals within 30 days from
the date of the decision.
