As used in this article, the following terms shall have the meanings indicated:
CITY
The City of Linwood.
CONTRACTOR
That individual or company who is under contract with the City of Linwood for installation of sewer laterals.
OWNER
Any individual or individuals who own real property in the City of Linwood and who are building in an individual capacity, as opposed to a developer.
On all new construction in the City of Linwood, an owner shall prepay to the City the standard charge for the installation of a sewer lateral to service said property. The owner shall also prepay all necessary City street opening application and inspection fees in accordance with Chapter 241 of the Code of the City of Linwood. The Superintendent will make the appropriate street opening permit application to the City on the owner's behalf.
The standard charge for installation shall be determined by the contractor on the basis of distance and depth and shall be based upon a rate fixed by the sewer service agreement which is in effect on the date of commencement of construction.
Any additional or unforeseen costs and expenses incurred by the contractor during the installation of a sewer lateral shall also be paid by the owner. If any conditions are present that require review or inspection by the Engineer, the owner shall reimburse the City for any and all fees encumbered in accordance with the Engineer's contract with the City. This reimbursement may at the City's discretion, be required in advance in the form of a review escrow. The issuance of a certificate of occupancy for said property is expressly conditioned upon prior payment of said cost and expenses in full.
This article shall apply to all new construction, except those cases involving a sewer extension wherein it is the developer's responsibility to install sewer laterals.
