No person, persons, firm, corporation or organization of any kind shall hold a public entertainment, picnic, carnival, parade or other similar gathering for amusement unless such person or persons or one of the officers of such corporation or organization shall make application to the Mayor, in writing, at least 30 days before the time when such occasion is proposed to be held. Such application shall state the date and hour when such occasion is to be held, the place where it is to be held, the approximate number of persons expected to attend, the objects, if for charitable purposes or for pecuniary profit, the names and addresses of the persons or officers intended to be in authority and such other information as the Mayor shall deem necessary.
In case such applicant or applicants shall desire to hold or conduct a parade or procession through the public streets of the Borough of Kenilworth, such application shall set forth, in addition to the information required by § 87-1 of this article, the purpose for holding such parade or procession, the route to be covered and the number of vehicles to participate therein.

Upon receiving any such application in writing, the Mayor shall, in his discretion, grant or refuse the applicant or applicants a permit, in writing, for holding such public entertainment, picnic, carnival, parade or other public gathering for amusement if he shall deem it best for the welfare, quiet and good of the Borough. The Mayor may, however, grant said permit under such terms and conditions as he shall see fit to impose.

Whenever any applicant or applicants shall desire a permit to hold a public entertainment, picnic, carnival or other public gathering for amusement, the Mayor may grant said permit upon the condition that regular or special policemen be stationed at such occasion to maintain order, the costs of which shall be paid by the applicant or applicants. He may also regulate the sale or giving away of any form of refreshments and the playing of any games or restrict the hours during which said occasion shall be held.
Whenever any applicant or applicants shall request the right to hold a parade or procession through the public streets of the Borough of Kenilworth, the Mayor may grant said permit upon the condition that regular or special policemen be stationed along the route of such parade or procession to maintain order, the costs of which shall be paid by the applicant or applicants. He may also change the route, hour or character of such parade or procession.
Whenever any permit shall be granted by the Mayor, the same shall be in writing, and in the event that any special terms or conditions are imposed by the Mayor prior to the granting of such permit, such terms and conditions shall be particularly specified in the permit.

In case a permit shall be granted by the Mayor permitting a public entertainment, picnic, carnival, parade or other public gathering for amusement to be held within the Borough of Kenilworth, the same shall be conducted in such a manner as to comply in all respects with the terms and conditions set forth in the permit. Should there be a failure to comply with such terms and conditions as set forth therein, or in the event that the same should be conducted in a disorderly manner, it shall be the duty of the regular policemen or special policemen stationed thereat to immediately disperse the same and arrest all persons conducting or participating therein.
In the event that the Mayor should be sick or absent from the Borough, application for a permit to hold such occasion shall be made to the President of the Borough Council. He, when acting in place of the Mayor, shall have all the powers vested in the Mayor by the provisions of this article.

A fee as provided in Chapter 91, Fees and Licenses, shall be paid to the Borough of Kenilworth upon the granting of any permit, which fee must accompany the application.

Any person, persons, firm or corporation of any kind violating this article or any section thereof shall be subject to the general penalty set forth in Chapter 1, Article I, General Penalty, of the Borough of Kenilworth Code.
Nothing herein contained shall apply to private funerals, wedding processions or any public gatherings for amusement conducted by religious or school organizations.
