§ 110-1 License required.

No person, firm or corporation shall maintain or operate any miniature golf course, golf driving course or any other game of a similar nature on any land or in any building within the Borough of Kenilworth, Union County, New Jersey, without first obtaining a license permitting the same in the manner hereinafter provided.

§ 110-2 Application for license.

Application for a license to operate any miniature golf course, golf driving course or any other game of a similar nature shall be made in writing to the Mayor and Common Council of the Borough of Kenilworth, Union County, New Jersey, and no such license shall be granted without the consent of a majority of the members of the Common Council as a whole and the approval of the Mayor.

§ 110-3 Fees. [1]

The fee for a license to operate a miniature golf course and the fee for a license to operate a golf driving course shall be as provided in Chapter 91, Fees. The fee for a license to operate any other game of a similar nature shall be as hereafter fixed by the vote of a majority of the members of the Common Council as a whole and the approval of the Mayor. All fees for licenses as aforementioned shall be payable in advance.

§ 110-4 Term of licenses.

All licenses hereafter issued by the Borough of Kenilworth, Union County, New Jersey, in accordance with the provisions hereof, permitting the operation of miniature golf courses, golf driving courses or any other games of a similar nature, shall be for a period of one year, commencing on May 1 and expiring on April 30.[1]

§ 110-5 Hours.

All miniature golf courses, golf driving courses or any other games of a similar nature duly licensed to operate as aforementioned within the Borough of Kenilworth, Union County, New Jersey, shall be closed at 12:00 midnight and shall remain closed until 7:00 a.m. next following.

§ 110-6 Prohibitions.

All miniature golf courses, golf driving courses or any other games of a similar nature duly licensed to operate as aforementioned within the Borough of Kenilworth, Union County, New Jersey, shall be operated in a lawful manner, and no person, firm or corporation operating the same shall countenance or permit any improper noise or disturbance upon the premises occupied and shall not impede or obstruct any public sidewalk or highway adjacent to the premises so occupied or permit the same to be done.

§ 110-7 Revocation of license.

In the event of the failure of any person, firm or corporation operating or maintaining a miniature golf course, golf driving course or any other game of a similar nature in the Borough of Kenilworth, Union County, New Jersey to comply with any of the provisions herein contained, the Mayor, with the consent of a majority of the members of the Common Council as a whole, shall have the right to revoke any licenses issued hereunder.
