The Chief of Police and the Building Inspector of the Borough of Kenilworth are hereby designated and appointed as the officers of the municipality to exercise the powers prescribed by this article in the manner hereinafter provided, their services, as such, to continue at the pleasure of the Borough Council.

If the Chief of Police shall determine at any time that any brush, hedges or other plant life growing within 10 feet of any roadway within the Borough of Kenilworth and within 25 feet of the intersection of any two such roadways obstructs the view of persons using such intersection so as to create a traffic hazard, he shall notify the owner or tenant of the lands on which same is growing to cut or trim same to a height of not more than 2 1/2 feet or in such other manner as he may designate as necessary to eliminate such hazard and to afford a clear and uninterrupted view at such intersection.
If the owner or tenant so notified fails to comply with the order to cut or trim such brush, hedges or other plant life within 10 days from the service of such notice as hereinafter provided, then the Chief of Police shall notify the Building Inspector of such fact, and the Building Inspector shall then proceed to have the Department of Public Works cut or trim same or have same cut or trimmed in such manner as to comply with said notice and to eliminate said hazard.
In all cases where brush, hedges or other plant life are cut or trimmed from any such lands by the municipality, the Building Inspector shall certify the cost thereof, in writing, to the Borough Council. The Borough Council shall examine such certificate and, if found correct, shall cause the cost, as shown therein, to be charged against said lands or, in the event that such cost is excessive, shall cause the reasonable cost thereof to be charged against said lands, and the amount so charged shall forthwith become a lien upon such lands and shall be added to, become and form a part of the taxes next to be assessed and levied upon such lands, same to bear interest at the same rate as other taxes, and same shall be levied, collected and enforced by the same officers and in the same manner as taxes.
The notice herein provided for shall be given by mailing same to the owner and tenant, if any, of said lands at the last known address of said owner and/or tenant as shown on the books of the Tax Collector of the Borough.
The Borough of Kenilworth and all persons affected by this article shall be entitled to the rights and remedies and subject to the restrictions and penalties as prescribed by Chapter 152 of the Laws of 1949.[1]
