This chapter shall be known and designated as the "Sanitary Code of the Borough of Kenilworth."

As used in this chapter, the following terms shall have the meanings indicated:
HEALTH AUTHORITY
The legal authority of the Board of Health of the Borough of Kenilworth and the authority conveyed upon its Health Officer.
HEALTH OFFICER
An individual licensed by the New Jersey Department of Health and Senior Services pursuant to N.J.S.A. Title 26 and employed by the Health Authority and includes his designee.

Upon payment of the applicable fee, all licenses regarding the sale and/or the distribution of food and/or beverages within the Borough of Kenilworth shall be issued by the Secretary of the Department of Health after written approval by the Health Officer subject to satisfactory compliance with N.J.A.C. Title 8, Chapter 24.

Any license issued under this article shall be conspicuously displayed to the public within the premises for which it was issued and upon each and every vehicle or device used in the business for which a license is required. Licenses shall be issued according to the risk type retail food facility as defined according to N.J.A.C. 8:24-1.5.
Every holder of a license shall exhibit same upon demand to any member of the Board of Health, the Health Officer or any authorized representative of the Board of Health.
It shall be lawful for any member of the Board of Health, the Health Officer, inspector or any person acting under and by the authority of the Board of Health to enter in or upon any premises for any of the purposes specified in this chapter or for any other purpose in connection with his regular duties.
A. 
The Board of Health shall have the right to revoke any license whenever the holder thereof or any of his servants or agents violate the terms under which same was issued. Before any license shall be revoked, a notice of the contemplated action of the Board of Health shall be served upon the holder of said license, setting forth such charges as may be the reason for said revocation and the place, date and hour when said Board will hear the matter.
B. 
Whenever any licensee shall violate the terms under which said license was issued, the Board of Health or the Health Officer shall have the right to suspend the operation of said license pending the hearing.
