The provisions of this article imposing a time
limit on parking shall not relieve any person of the duty to observe
other and more restrictive provisions prohibiting or limiting the
stopping, standing or parking of vehicles as set forth in N.J.S.A.
39:4-138, any other New Jersey statute or as hereinafter provided.
A.
No person shall park a vehicle at any time upon
any of the streets or parts thereof described in Schedule I (§ 10.20.010),
attached to and made a part of this chapter.
B.
Schools. Parking shall be prohibited in the
designated areas adjacent to the following structures pursuant to
N.J.S.A. 39:4-197:
(1)
Montville High School: that portion of the driveway
beginning at the sidewalk along the south side of the building which
faces Horseneck Road and continuing around the front of the building
around to and including both sides of the driveway from the northeast
side of the building to the auto shop area.
(a)
Parking by permit only shall be
allowed in all areas on the school grounds. Unauthorized vehicles
shall be towed at the owner's expense.
(b)
All vehicles shall park within
designated areas defined by lines under the Uniform Traffic Manual.
Vehicles failing to park as required shall be towed at the owner's
expense.
(c)
Hours for the above section shall
be in effect from 7:00 a.m. to 5:00 p.m. on days when school is in
session. The owner of any disabled vehicle shall notify the school
for special permission to park overnight. No vehicle shall remain
on the school grounds for more than a twenty-four-hour period. If
said vehicle remains longer, it shall be towed at the owner's expense.
(2)
Woodmont School: that portion of the driveway
beginning at the north side of the driveway from Woodmont Road along
the south side of the building and continuing to the front of the
building and the main entrance and beyond that to the end of the sidewalk.
(3)
Hilldale School: the entire driveway.
(4)
Valley View School: that portion of the driveway
beginning at the south side of the building beyond the gym area and
coming down around the front of the building to the end of the sidewalk
which terminates at Montgomery Avenue.
(5)
Cedar Hill School: the entire curb area along
the front of the building, beginning at the parking lot and coming
around the curb to a point beyond the kindergarten area, together
with the fire zone painted on the south playground.
(6)
Central School: the curb area starting on the
north side of the building, including the total curb area adjacent
to the building plus the south side of the building around to the
library entrance.
(7)
William Mason School: the total curb area along
the front of the building. The driveway shall be made one-way, with
the entrance to be located on the parking lot side of the school.
C.
Fire zones adjacent to Town Hall.
(1)
Parking shall be prohibited in the following
designated areas adjacent to the Town Hall pursuant to N.J.S.A. 39:4-197:
that portion of the parking lot beginning on the east side of the
parking lot at the entrance intersection with Eckhardt Circle and
continuing along the easterly side of the parking lot and in a continuous
line around to the front entrance area of the building up to and including
the area immediately adjacent to and at the start of the handicapped
parking area located at the entrance to the building and continuing
thereafter on the same side of the building adjacent to the end of
the handicapped area and continuing along the front curbline down
the driveway along the northeast side adjacent to the building through
and including the area where the dumpster is located and turning and
continuing along said northeast side and including the north end of
the driveway and then returning along the westerly side of the driveway
in a southerly direction with the exception of three fifteen-minute
loading zones, properly marked and signed, up to and including the
point of intersection with Eckhardt Circle; in addition thereto, that
area located on the southerly side of the curbline across from the
flag pole parking area and the handicap circle continuing along the
outside of the parking area on that southerly side of the drive around
the radius of each turn for three feet at both parking locations.
The plan designating this no-parking zone shall be kept on file at
the office of the Township Clerk and at the Montville Township Police
Department.
No person shall park a vehicle between the hours
specified in Schedule II (§ 10.20.020) of any day, except
Sundays and public holidays, upon any of the streets or parts of streets
described in said Schedule II, attached to and made a part of this
chapter.
No person shall stop or stand a vehicle during
the times specified in Schedule III (§ 10.20.030) of any
day, except Sundays and public holidays, upon any of the streets or
parts of streets described in said Schedule III, attached to and made
a part of this chapter.
No person shall park a vehicle for longer than
the time limit shown in Schedule IV (§ 10.20.040) at any
time between the hours listed in said Schedule IV of any day, except
Sundays and public holidays, upon any of the streets or parts of streets
described in Schedule IV, attached to and made a part of this chapter.
A.
Whenever snow has fallen and the accumulation
is such that it covers the street or highway, no vehicle shall be
parked on either side of any of the streets or parts thereof described
in Schedule XVII (§ 10.20.170), attached to and made a part
of this chapter.
B.
The above parking prohibitions shall remain
in effect after the snow has ceased until the streets have been plowed
sufficiently and to the extent that parking will not interfere with
the normal flow of traffic.
A.
Upon the declaration of an emergency, there
shall be no parking upon streets or sections of streets where temporary
emergency no-parking signs are displayed. The Chief of Police, or
in his absence the ranking police officer, is authorized to declare
an emergency and to direct the posting of said emergency no-parking
signs when weather conditions, accidents, fires or public celebrations
dictate or require the avoidance of hazards or other conditions which
interfere with the free flow of traffic.
B.
Notification that the emergency no-parking signs
are being or will be posted shall be given the operator or owner of
any vehicle which has been parked prior to the posting of the signs.
Any unoccupied vehicle parked or standing in
violation of this article shall be deemed a nuisance and a menace
to the safe and proper regulation of traffic, and any peace officer
may provide for the removal of such vehicle. The owner shall pay the
reasonable costs of the removal and storage which may result from
such removal before regaining possession of the vehicle.
The effectiveness of this article is contingent
on signs being erected as required by law.

A.
Between the hours of 8:00 p.m. and 7:00 a.m.
Monday through Friday and all times on Saturday and Sunday, it shall
be unlawful for any person to park, store, or maintain any commercially
operated vehicle or any construction equipment, vehicle, or machinery
on any street, highway, or public place in the Township of Montville;
provided, however, that nothing herein shall prohibit the parking
of a vehicle for the purpose of installing, maintaining, or performing
a public utility service or emergent homeowner service.
B.
COMMERCIAL VEHICLE
As used in this section, the following terms
shall have the meanings indicated:
Every type of vehicle used for commercial purposes, including
but not limited to vehicles used to transport persons or property
for compensation or used in the furtherance of and/or performance
of a specific job or work function. The term "commercial vehicle"
shall not include vehicles for private or personal transportation.

A.
Student parking by permit only.
(1)
The Township of Montville hereby designates the northern length
of Horseneck Road between the most westerly entrance drive to Montville
Township High School and westerly limit of Montville Township High
School property frontage as a permit parking area for parallel parking
for the students of the Montville Township High School. The designated
space shall be permit parking between the hours of 6:00 a.m. to 3:00
p.m. on Mondays through Fridays, September through June. During this
time period, only vehicles displaying valid permit parking hangtags
issued by the Montville Township Police Department may stand or be
parked. There shall be up to but no more than 36 spaces allotted and
36 parking hangtags issued.
(2)
The parking hangtag shall be clearly displayed by being hung
from the rearview mirror.
(3)
The Chief of Police shall cause signs to be posted along Horseneck
Road designating the street as "Parking by Permit Only."
B.
Issuance of permit parking hangtags.
(1)
The Township of Montville Police Department shall issue permit
parking hangtags to those students pursuant to a list provided by
the Montville Township Board of Education. Any student receiving a
permit parking hangtag shall be required to complete an application
to be promulgated by the Police Department. There shall be no charge
for the issuance of a parking hangtag. A replacement hangtag shall
be at a fee of $5.
C.
Violations and penalties.
(1)
Invalid parking. Any vehicle parked on Horseneck Road without
a valid parking hangtag shall be subject to penalties in accordance
with § 10.08.020C(2). If an unauthorized vehicle is left
for a continuous twenty-four-hour period, it will be towed. The vehicle
owner/operator shall be responsible for the cost of the vehicle tow
and storage.
(2)
Counterfeit. It shall be unlawful for a person to copy, produce or otherwise bring into existence a facsimile or counterfeit parking hangtag. It shall be unlawful for a person to knowingly use or display an altered, facsimile or counterfeit parking hangtag in order to invalidly park on Horseneck Road. Such a violation shall result in a penalty as are provided for in Chapter 1, Article II, General Penalty.
