This article applies to all underground storage tanks containing hazardous substances as said terms are defined herein, except for those tanks already regulated by the Underground Storage Tank Act, N.J.S.A. 58:10A-21 et seq., and the regulations adopted pursuant thereto, N.J.A.C. 7:14B-1 et seq.

As used in this article, the following words and terms shall have the following meanings:
HAZARDOUS SUBSTANCE
Fuel of any nature, including, without limitation, heating oil, gasoline, kerosene and diesel fuel.
TOWACO VALLEY AQUIFER
That area depicted on the Montville Township Zoning Map as the Critical Water Resources (CWR) District, as amended from time to time.
UNDERGROUND STORAGE TANK
Any container or receptacle in excess of 99 gallons located in the ground or in an underground area, including, without limitation, basements, cellars or any other underground area, which container or receptacle is otherwise exempt from regulation by the New Jersey Department of Environmental Protection under the Underground Storage Tank Act, N.J.S.A. 58:10A-21 et seq., and the regulations adopted pursuant thereto, N.J.A.C. 7:14B-1 et seq.
A. 
After written notification by the Water and Sewer Department, any person that owns or operates an underground storage tank containing a hazardous substance as defined in this article on property located within the Towaco Valley Aquifer limits shall register within 60 days of the date of such notice, each tank with the Water and Sewer Department by providing the following information to the Water and Sewer Department on forms prepared by the Water and Sewer Department:
(1) 
The name and address of the contact person for the underground storage tank;
(2) 
The name and address of the owner of the underground storage tank;
(3) 
The number and type of underground storage tank located on the property, including, but not limited to, contents, size, age, type of construction and other characteristics of the tank;
(4) 
A site plan of the property, including the location of the tank(s), line(s), pump(s), dispenser(s), fill pipe(s), and other features of the tank, including the distance from existing buildings and property boundaries;
(5) 
The operational status of the underground storage tank (i.e., whether the tank is being installed, abandoned, removed, sold or transferred, or substantially modified).
B. 
Upon submission of the foregoing information, the Water and Sewer Department shall issue a registration certificate valid for three years.
C. 
The holder of the registration certificate shall notify the Water and Sewer Department of any changes in the information supplied to the Water and Sewer Department for the issuance of the registration certificate.
D. 
Not more than 90 days prior to the expiration of the registration certificate, the Water and Sewer Department shall notify the holder of said registration certificate of the need to renew the certificate and supply the renewal forms to said holder.

Failure to comply with the requirements of this article by the owner or operator of property containing an underground storage tank after written notification by the Authority shall subject the owner and/or operator of the underground storage tank to such penalties as are provided for in Chapter 1, Article III, General Penalty.
