GENERAL REFERENCES
Swimming pools — See Ch. 415.
There be and hereby is created a public utility
in accordance with N.J.S.A. 40:62-1 et seq., the purpose of which
will be to own and operate a recreational facility in the Borough
of South Plainfield known as the "South Plainfield Swimming Pool Complex."
All fiscal matters involved in the operations
of said swimming pool utility shall be in accordance with N.J.S.A.
40A:2-1 et seq. (Local Bond Law); N.J.S.A. 40A:4-1 et seq. (Local
Budget Law); N.J.S.A. 40A:11-1 et seq. (Local Public Contracts Law);
N.J.S.A. 40:61-22.21 (Swimming pools and other recreational facilities);
N.J.A.C. 5:30-2.8 (Self Liquidating Improvements and Extensions) and
all other applicable statutes governing municipalities and utilities
and their amendments and supplements.
All moneys and revenues derived from the operation
of the pool utility shall be kept in a separate fund by the Borough
Treasurer, designated as the "Borough of South Plainfield Pool Utility
Operating Account," and shall be applied and accounted for in accordance
with the Local Budget Law, N.J.S.A. 40A:4-1 et seq.
The supervision and control over the maintenance,
operation and regulation of the South Plainfield Swimming Pool Complex
shall be under the direction of the South Plainfield Recreation Commission.
The governing body shall adopt rules and regulations
pertaining to the operation and collection of fees or other charges
for admission, which rules and regulations shall be implemented by
the South Plainfield Recreation Commission in its supervision of the
South Plainfield Swimming Pool Complex.[1] Said rules and regulations shall include fines and penalties
to be assessed by the South Plainfield Municipal Court for violations
of any such rules and regulations.
