The governing body of the Borough of South Plainfield
hereby declares that graffiti displayed upon public and private property
is a public nuisance and that spray paint containers are sometimes
used for this purpose.
Any person under the age of 18 years shall not
possess upon his person spray paint dispensing containers.
It shall be unlawful for any merchant to sell
spray paint dispensing containers to any person under the age of 18
years.
A.
Any person who sells, gives or otherwise transfers
spray paint dispensing containers to any other person under the age
of 18 years shall be in violation of this chapter and, upon conviction,
be punished by a fine not exceeding $1,000.
B.
Additionally, such person adjudged to be in violation
of this chapter shall, in addition to the fine, pay the full cost
of remediating any graffiti produced by the person under 18 years
old, whether or not said violator had actual custody, control or knowledge
of the graffiti acts.
