This chapter is entitled "A Local Law to Authorize the Board
of Trustees of the Village of Monticello, New York, to Impose Fees
to Defray the Cost of Annexation Proceedings."
The Board of Trustees of the Village of Monticello, New York,
is hereby authorized to establish by resolution a fee to defray the
expenses incurred by the Village in conducting an annexation proceeding
under Article 17 of the General Municipal Law.
Moneys collected by the Village as fees for annexations shall
be used to defray all necessary Village expenses in conducting the
annexation proceeding for which application is made, including but
not limited to the cost of publishing all notices which are or may
be required by law, the cost of conducting required public hearings
and any other required legal proceedings, including the cost of preparing
necessary documents and counsel fees, and the cost of holding any
elections which may be required by law.

When
to be paid. The fee imposed hereby shall be payable by the persons,
firms, associations and/or corporations which submit a petition for
annexation at the time of the submission of such petition. No petition
for annexation to the Village of Monticello shall be received by the
Board of Trustees or by any other officer or employee of the Village
until the fee authorized herein and established by resolution of the
Board of Trustees shall have been paid.

Method
of payment. Payment of the fee authorized herein shall be in cash
or by certified or cashier's check drawn to the order of the
Village of Monticello.
