A.
The owner of every animal which at any time is kept, brought or comes
within the Village will be held responsible for the strict observance
by such animal and with respect to such animal of all the rules and
regulations contained in this article at all times when such animal
is within the Village.
B.
No person owning, harboring, keeping, walking or having the custody
or control of a dog shall cause, permit, suffer or allow such dog
to soil, defile, defecate on or commit any nuisance on any Village
property, common thoroughfare, sidewalk, passageway, bypath, play
area, park or any other public property or private property, unless
such person shall have the express written permission of the owner
of said property. The Police Department of the Village of Monticello
shall be the Enforcement Officers of the provisions of this article.[2]

It shall be unlawful to keep more than two cats and two dogs,
four months old or older, on any premises regardless of the number
of owners.[1]

The owner of every cat shall securely fasten around the neck
of such cat a collar bearing the owner's name and address in
a clear and distinguishing manner.
It shall be unlawful for any animal determined to be dangerous
to be at large within the Village of Monticello at any time, even
though such animal is licensed, muzzled and effectively immunized
against rabies. A dangerous animal which is found at large may be
taken and impounded. If any dangerous, fierce or vicious animal found
at large cannot be safety taken up and impounded, such animal may
be summarily slain.

No dog shall be taken upon or permitted in any establishment
where food or food products are kept for resale, except guide dogs,
service dogs, hearing dogs, therapy dogs and detection dogs, as defined
by the Agriculture and Markets Law and bearing the special tag authorized
by § 111 of the Agriculture and Markets Law.
Any dog or cat at large which does not display any current dog
license or other means of identification, or which fails to exhibit
any evidence of having had administered to it a rabies vaccination,
shall be considered an abandoned dog or cat and may be summarily impounded
by the Dog Control Officer.[1]

A.
It shall be unlawful for any person in the Village of Monticello
to torture, torment, deprive of necessary sustenance, unnecessarily
or cruelly beat or otherwise abuse, or needlessly mutilate or kill
a living animal or creature. Any animal so treated shall be impounded
by the Dog Control Officer. The owner thereof shall be notified, in
writing and by personal service or by regular mail, of the alleged
violation, and the matter shall be referred to the Village Justice
for hearing and determination.
B.
Animal shelters and pens. Shelters shall be located at least 15 feet
from property lines and 25 feet from buildings. No pen shall be located
in any front yard. Pens located outdoors shall not be larger than
three feet by four feet or taller than five feet. Pens and shelters
shall be maintained in a safe, sound and sanitary condition.[1]

Except as otherwise provided in § 118 of the Agriculture and Markets Law, any person committing an offense against any provision of this article shall, upon conviction thereof, be guilty of a violation, punishable as provided in Article III, General Penalty, of Chapter 1 of the Code of the Village of Monticello.
