[HISTORY: Adopted by the Board of Trustees of the Village of Monticello 1-5-1976 by L.L. No. 1-1976 (Ch. 59 of the 1976 Code). Amendments noted where applicable.]
The tearing down or removal of any building, the dimensions of which are greater than 10 feet by 15 feet and 10 feet in height, located at a distance closer than 25 feet to any sidewalk, street, highway or public thoroughfare in the Village of Monticello, is hereby prohibited unless a permit therefor shall first be obtained from the Village Manager authorizing such activities.

No such permit shall be issued unless adequate facilities for the protection of the public are constructed as determined by the Code Enforcement Official, including the obtaining of liability coverage in limits of $1,000,000 indemnifying the Village against any resulting claims.
The fee for such permit shall be as established from time to time by resolution of the Board of Trustees.[1]

No permit shall be issued except upon payment of a bond as shall be determined by a resolution of the Board of Trustees from time to time.

Upon removal of the building or structure in question, the ground where the structure was located shall be filled and leveled with natural earthen or masonry material as defined in ยงย 139-6 of the Village Code as same is written or may hereafter be revised, and such area shall be covered with clean fill, seeded, and mulched.

Upon satisfactory completion of all work contemplated by this chapter, such bond shall be returned. In the event of failure to complete the work in a satisfactory manner with due diligence and upon 10 days of notice of such failure to complete the work, the bond will be forfeited and the Village may complete the work or contract the work and charge to the owner of the property all expenses for same which exceed the amount of bond forfeited. If unpaid within 10 days and upon notice to the bond holder, the Village may levy the charges authorized by this subsection on the property tax rolls for the parcel in question.

Any person committing an offense against any provision of this chapter shall, upon conviction thereof, be guilty of a violation, punishable as provided in Article III, General Penalty, of Chapter 1 of the Code of the Village of Monticello.
