This chapter of the Code of the Village of Horseheads shall be known and entitled as "Local Law No. 2-1984 for the Village of Horseheads, Chemung County, New York."
The purpose of this chapter is to promote the public health, safety and welfare of the Village of Horseheads, including the protection and preservation of the property of the village and its inhabitants, by establishment of a procedure whereby the efficient and prudent administration of the municipal affairs is promoted through creation of a procedure allowing for the establishment or fixing of annual salaries of elected officials of the Village of Horseheads.
It is the finding of the Village Board of the Village of Horseheads that the public health, safety and welfare of the community, its property and inhabitants would be best served by the efficient administration of municipal government by providing for a procedure for establishing and periodically modifying the salaries of elected officials of the Village of Horseheads inclusive with the annual budgetary process.
A. 
The Village of Horseheads has a number of offices which are filled by election. Those offices currently are the Mayor, four (4) Trustees and two (2) Justices. The number and composition of these offices may change from time to time pursuant to New York State law; additional or other elected offices may be created in the future pursuant to law. Formerly, the salaries for these elective offices have been set or established by local law, among other methods. Commencing with the first fiscal year following the effective date of this chapter and continuing annually thereafter, the salary and wage, if any, of all elective offices of the Village of Horseheads will be fixed and established as those salaries specified with respect to each of those offices in the schedule of salaries and wages of the annual budget adopted in accordance with law. The Board of Trustees shall not fix or establish the salaries of the Mayor, the Board of Trustees or the Village Justices or any other elective office at an amount in excess of the amount respectively established and set forth in said schedule of salaries and wages.
B. 
With respect to elective offices which are hereafter created and for which no salary has been established in the then-effective village budget, the salary for such offices shall be established by resolution of the Board of Trustees of the Village of Horseheads. In the event that an existing or hereafter created office shall become vacant, regardless of the cause, and thereafter be filled by lawful appointment, the salary to be paid to such appointee shall be set and established by resolution of the Board of Trustees. Such salary shall be effective through the conclusion of the fiscal year in which the appointment or creation of the office occurs. Thereafter, the salary shall be established or fixed pursuant to the budgetary process as noted above for all other elected officials.
This chapter is subject to a permissive referendum and shall be effective upon the expiration of the required period of time following posting and legal publication without the filing of a proper demand for referendum. If a proper demand for referendum is filed, only following approval by the electorate and upon its proper filing for publication with the Secretary of State shall this chapter become effective. In any event, this chapter shall not become effective until June 1, 1985, subject to the foregoing conditions. Payment of the salaries set in accordance with this chapter shall commence only upon completion of the foregoing proper legal procedures.[1]
