The foregoing whereas clauses are incorporated herein and specifically made a part of this article.[1]

Editor's Note: Said whereas clauses provide as follows:
"WHEREAS, the intent, purpose and scope, in part, of the Pennsylvania Municipalities Planning Code, Act 247, as amended, is to protect and promote the safety, health and general welfare of its citizens; and
"WHEREAS, the Pennsylvania Municipalities Planning Code, Act 247, as amended, promotes safety, health and general welfare, in part, by facilitating the future development and growth of Land Development and Subdivisions, as therein defined; and
"WHEREAS, by Ordinance No. 165, the Township of Muhlenberg Board of Commissioners adopted the Muhlenberg Township Subdivision and Land Development Ordinance, pursuant to the Pennsylvania Municipalities Planning Code, Act 247, as amended; and
"WHEREAS, both the Pennsylvania Municipalities Planning Code, Act 247, as amended, and the Muhlenberg Township Subdivision and Land Development Ordinance, as amended, govern and regulate Land Development and Subdivisions which have been proposed by various property owners or applicants within the corporate limits of the Township of Muhlenberg; and
"WHEREAS, both the Pennsylvania Municipalities Planning Code, Act 247, as amended and the Muhlenberg Township Subdivision and Land Development Ordinance, as amended, periodically require the services of the Township Engineer to provide engineering services which inure to the benefit of the various property owners or applicants in connection with Land Development and Subdivisions within the corporate limits of the Township of Muhlenberg; and
"WHEREAS, the Board of Commissioners of the Township of Muhlenberg have determined that it is in the best interest of the Township of Muhlenberg to have the actual costs for these engineering services assessed to the applicant, as herein defined, rather than charged to the Township and subsequently reimbursed out of the general fund of the Township; and
(Therefore, this article shall be adopted.)
The Board of Commissioners of the Township of Muhlenberg hereby authorizes the Township of Muhlenberg to assess to the property owner or applicant the actual costs for engineering services rendered in connection with land development and subdivisions within the corporate limits of the Township of Muhlenberg.
The property owner or applicant shall be assessed engineering fees for engineering services rendered when said engineering services are directly related to the applicant's land development or subdivision, so long as said engineering fees are based on the actual costs of the engineering services rendered and are performed pursuant to the Pennsylvania Municipalities Planning Code, Act 247, as amended, and the Muhlenberg Township Subdivision and Land Development Ordinance, as amended,[1] or performed at the request of the property owner or applicant.

The Township of Muhlenberg shall forward to the applicant an invoice for actual costs for said engineering services rendered by the Township Engineer pursuant to the Pennsylvania Municipalities Planning Code, Act 247, as amended, and the Muhlenberg Township Subdivision and Land Development Ordinance, as amended.
The Township of Muhlenberg shall forward said invoice to the address as stated by the applicant on the application for review of land development or subdivision, as required by the Muhlenberg Township Subdivision and Land Development Ordinance of 1980, as amended.
Pursuant to the Muhlenberg Township Subdivision and Land Development Ordinance of 1980, as amended, the Board of Commissioners of the Township of Muhlenberg shall not affix its original signature to any proposed final plan for recording with the Berks County Recorder of Deeds, unless and until the Township Secretary, as defined by the First Class Township Code, attests that all actual costs for engineering services rendered as herein defined have been paid in full by the applicant.
