A certain document, a copy of which is on file in the office of the Borough Secretary of the Borough of Eddystone, being marked and designated as the BOCA National Plumbing Code, Seventh Edition, 1987, as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Plumbing Code of the Borough of Eddystone, Delaware County, Pennsylvania; for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Plumbing Code are hereby referred to, adopted and made a part hereof as if fully set out in this chapter, with the additions, insertions and changes, if any, prescribed in § 222-2 of this chapter.
A. 
The following sections are hereby revised as follows:
(1) 
Section P-100.1 (page 1, second line), insert: "Borough of Eddystone, Delaware County, Pennsylvania."
(2) 
Section P-104.1 (page 2, second line), insert: (DATE OF ADOPTION).
(3) 
Section 114.2 (page 8, third line) insert:

(a) 
Any person, firm or corporation who shall contract to perform or who shall perform any heating work within the Borough of Eddystone must pay a heating license fee of $30 prior to the commencement of any work on any heating system. The license obtained hereunder shall be a yearly license that shall run from January 1 of the given year and expire on December 31 of the same given year.
(b) 
Any person, firm or corporation who shall contract to perform or who shall perform any plumbing work within the Borough of Eddystone must pay a plumbing license fee of $50 prior to the commencement of any plumbing work. The license obtained hereunder shall be a yearly license running from January 1 of the given year and expiring on December 31 of the same given year.
(c) 
Fee schedule. The following plumbing permit fees shall be paid to the Borough of Eddystone upon filing of an application and shall apply to all plumbing work performed in the Borough. The fee shall be based on the actual contract price of any such work or, if no contract price has been agreed upon, then the applicant's estimated cost; provided, however, that upon review of the Plumbing Inspector, with the assistance of the Borough Engineer, if required, such contract price or estimated cost is unrealistic, then the Plumbing Inspector shall make the estimate of the cost which shall be final.

Residential. New construction, alterations, additions and repairs: $20 per $1,000 of cost or fraction thereof.
[2] 
All new construction, other than residential: $30 per $1,000 of cost or fraction thereof for the first $50,000, then $15 per $1,000 of cost or fraction thereof for cost above $50,000.

All alterations, additions and repairs other than residential: $30 per $1,000 of cost or fraction thereof for the first $20,000, then $15 per $1,000 of cost or fraction thereof for cost above $20,000.

Work started prior to obtaining permit: Where work for which a permit is required by this chapter is started prior to obtaining the required permit, the fees set forth herein for such permit shall not relieve any persons from fully complying with the requirements of this chapter in the execution of the work or from any other penalties prescribed herein.

Section P-117.4 (page 9) shall be amended to read as follows:

P-117.4 Violations and penalties: Any person who shall be convicted of a violation of any of the provisions of this chapter before any District Justice shall be sentenced to pay a fine of not more than $1,000 and cost of prosecution and, in default thereof, to imprisonment in the county jail for a term not to exceed 30 days.

B. 
Certificate of insurance. Upon application for a permit in accordance with Section P-111.0 of the BOCA National Plumbing Code, Seventh Edition, 1997, the person or agent applying for the permit shall provide the code official responsible for issuing the plumbing permit, in addition to all other requirements for issuance of a permit, with a certificate of insurance showing proof that the person or agent applying for the plumbing permit has comprehensive liability insurance providing coverage for damage to property or injury to persons, including employees of the person or agent applying for the permit, in the following limits:

(1) 
Workers' compensation and employers' liability insurance: $100,000 each accident; $500,000 disease, policy limit; and $100,000 disease, each employee.
(2) 
General liability insurance: $300,000 bodily injury and property damage combined, each occurrence; $300,000 bodily injury and property damage combined, aggregate.
(3) 
Automobile liability: $300,000 bodily injury and property damage combined, each occurrence. This insurance shall cover all owned vehicles (other than private passenger vehicles), hired vehicles and nonowned vehicles.
Nothing in this chapter or in the Plumbing Code hereby adopted shall be construed to affect any suit or proceeding impending in any court or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in this chapter; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.
