the 1974 Code]
The owner of land abutting on any highway, street
or public place in front of whose premises an artificial sidewalk
has been or shall be constructed shall, at his own cost and expense,
maintain and repair such sidewalk in front of such premises.
Upon the default or neglect of any owner of
land to maintain or repair any sidewalk in front of his premises for
15 days after written notice from the Board of Selectmen to do so,
the Board may repair such sidewalk and the expense of such repair
shall be a lien upon the premises adjoining such sidewalk, provided
that the Board of Selectmen shall cause a certificate of lien against
such premises to be recorded in the Town Clerk's office within 60
days from the completion of such repair, and such lien shall be prior
to all other liens except tax liens.
A.
Every owner of any lot or parcel of land which abuts
any street in the Town, the surface of which lot or parcel of land
is lower than the sidewalk or footpath adjoining the same, shall,
when ordered to do so by the Board of Selectmen, cause a suitable
fence or railing to be erected and maintained to protect users of
said sidewalk or footpath.
B.
If any owner shall, when ordered to do so by the Selectmen,
fail to erect or cause to be erected such fence or railing within
30 days after date of said notice, the Selectmen shall erect such
fence at the expense of the owner, the cost of which shall be a lien
against the owners of said premises. Thereafter, unless the cost thereof
shall have been tendered to the Selectmen, the Selectmen shall cause
to be recorded a certificate of lien on the land records of the Town
in favor of the Town and against the owner. Said lien shall have precedence
over all liens except liens of taxes.
