As used in this chapter, the following terms shall have the meanings
indicated:
A narrow board of wood, plastic, fiberglass or similar material with
roller-skate or other type wheels attached thereto, used for rolling, gliding
or moving on any hard surface.
The Village of Fort Plain, New York.
Any and all streets, highways and roadways, whether belonging to
the Village or the State of New York, that are located anywhere within the
Village which are used for vehicle traffic, including any streets, highways
or roadways located within any municipal parks located within the Village.
It shall be unlawful for any person to use, operate or ride a skateboard
on any Village streets, sidewalks or parks within the Village at any time
or on any private property within the Village without having first obtained
the permission of the landowner.
A.
A first violation of this chapter shall be punishable
by a fine of not more than $100.
B.
Any second or subsequent violation of this chapter shall
be punishable by a fine of not more than $250 or by imprisonment for not more
than 15 days, or both. In addition thereto, upon the second or any subsequent
violation of this chapter, any person charged with a violation of this chapter
based on the personal observation of the police officer making such charge
shall have his or her skateboard confiscated at the time such subsequent charge
is made, and such skateboard shall not be returned to the owner or user thereof
unless it shall be determined by the court having jurisdiction that a violation
of this chapter shall not have occurred.

As used in this article, the following terms shall have the meanings

The streets, sidewalks, parks, parking areas including and adjacent
to Willett Street from Main Street to Webster Street, Canal Street from Main
Street to Prospect Street, Main Street from Willett Street to South Street,
River Street, Legion Street, Plaza Street, Division Street from Canal Street
to Center Street, Mohawk Street from Canal Street to Center Street and Center
Street from Mohawk Street to Main Street.
A roller skate whose wheels are arranged in a straight line.
A shoe or boot with wheels or casters attached to its sole for skating
on hard surfaces.
The Village of Fort Plain, New York.
It shall be unlawful for any person to use in-line skates or roller
skates in the business area of the Village at any time.
A.
No person shall use in-line skates or roller skates upon
any private property in the Village without obtaining the permission of the
landowner.
B.
No person shall use in-line skates or roller skates upon
any public street, highway, sidewalk, park or parking area in the Village
in any place where same is not expressly prohibited, except in a prudent and
careful manner and unless such person maintains control and operates in a
prudent manner with reasonable regard to the safety of such person, other
persons and/or the general public.
A.
A first violation of this article shall be punishable
by a fine of not more than $100.

Any second or subsequent violation of this article shall
be punishable by a fine of not more than $250 or by imprisonment for not more
