A. 
When any vehicle is parked or abandoned on any highway or public parking lot within this village during a snowstorm, flood, fire or other public emergency which affects that portion of the public highway or parking lot upon which said vehicle is parked or abandoned, said vehicle may be removed by or under the direction of any regular or special police officer of the Village of Fort Plain Police Department.
B. 
When any vehicle is found unattended on any highway or public parking lot within the village where said vehicle constitutes an obstruction to traffic, said vehicle may be removed by or under the direction of any regular or special police officer of the Village of Fort Plain Police Department.
C. 
All regular and special police officers of the Village of Fort Plain Police Department shall have the power to cause the removal and disposal of any vehicle left unattended for more than 24 hours within the right-of-way of any street within the village or any other public property of the village.
After removal of any vehicle as provided in this Article, the village may store or cause such vehicle to be stored in a suitable place at the expense of the owner. Such owner or person in charge of the vehicle may redeem the same upon payment to the person with whom stored of the amount of all expenses actually and necessarily incurred in effecting such removal and storage, such storage charges not to exceed a fee as set by resolution of the Village Board of Trustees. The village shall in no event be liable to any private contractor or owner for such charges.
It shall be the duty of any regular or special police officer of the Village of Fort Plain Police Department to ascertain to the extent possible the owner of the vehicle or the person having the same in charge and to notify him of the removal and disposition of such vehicle and of the amount which will be required to redeem the same. Said police officer shall also, without delay, report to the Village Clerk the removal and disposition of any vehicle removed as provided in this Article.
In the case of unclaimed vehicles under this Article, the Village Clerk or Deputy Village Clerk, or other village official designated by the Board of Trustees, may sell the same at public sale. Notice of such sale shall be posted conspicuously in at least three public places in the village at least six days before the date of the sale. The official conducting the sale may, in his discretion, give other publicity of such sale, or he may delay the sale in the interest of justice.
