[HISTORY: Adopted by the City Council of the City of Salem as Ch. XVII of the 1975 Municipal Code. Amendments noted where applicable.]
Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to such words and phrases used herein.
The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statutes or as hereinafter provided.
No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule I, § 225-25, attached to and made a part of this chapter.

No person shall park a vehicle between the hours specified in Schedule II, § 225-27, of any day (except Sundays and public holidays) upon any of the streets or parts of streets described in said Schedule II, attached to and made a part of this chapter.

No person shall stop or stand a vehicle between the hours specified in Schedule III, § 225-28, on any day (except Sundays and public holidays) upon any of the streets or parts of streets described in said Schedule III, attached to and made a part of this chapter.
No personal shall park a vehicle for longer than the time limit shown in Schedule IV, § 225-29, at any time between the hours listed in said Schedule IV of any day (except Sundays and public holidays) upon any of the streets or parts of streets described in Schedule IV, attached to and made a part of this chapter.

Parking shall be prohibited within the specified distances from the curb of the indicated intersections on streets designated in Schedule X, § 225-36.

Between the hours of 8:00 a.m. and 6:00 p.m., except on Sunday and holidays, parking in the City municipal lot located in the area between the county parking lot and the commercial buildings on East Broadway shall be limited to a two-hour time period.

Trucks over four tons' gross weight are hereby excluded from the streets or parts of streets described in Schedule V, § 225-31, except for the pickup and delivery of materials on such streets; said Schedule V being attached to and made a part of this chapter.

No person shall park a truck, bus, tractor, trailer or semitrailer on any street in the City of Salem, between the hours of 9:00 p.m. and 6:00 a.m. of any day. This prohibition shall apply to any vehicle having six or more wheels or any vehicle with a gross vehicle weight in excess of four tons; excluded from the above prohibition are emergency or service vehicles while actually engage in emergency or service calls.
The streets or parts of streets described in Schedule VI, § 225-32, attached to and made a part of this chapter, are hereby designated as one-way streets in the direction indicated.
Pursuant to the provisions of N.J.S.A. 39:4-140, the streets or parts of streets described in Schedule VII, § 225-33, attached to and made a part of this chapter, are hereby designated as through streets. Stop signs shall be installed on the near right side of each street intersecting the through street except where yield right-of-way signs are provided for in the designations.
Pursuant to the provisions of N.J.S.A. 39:4-140, the intersections described in Schedule VIII, § 225-34, attached to and made a part of this chapter, are hereby designated as stop intersections. Stop signs shall be installed as provided therein.
Pursuant to the provisions of R.S. 39:4-140, the intersections described in Schedule IX, § 225-35, attached to and made a part of this chapter, are hereby designated as yield intersections. Yield right-of-way signs shall be installed as provided therein.

Unless another penalty is expressly provided by New Jersey statute, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of no more than $50. In addition, the operator of a motor vehicle shall not stand or park said vehicle in any space on public property, a public street or private property designated as restricted parking for the physically handicapped pursuant to P.L. 1977, c. 202 (N.J.S.A. 39:4-197.5), P.L. 1975, c. 217 (N.J.S.A. 52:270-119 et seq.), or any other applicable law unless the vehicle is authorized by law in a identifiable manner to be parked therein and the driver or passenger of said vehicle is handicapped. Any person who shall violate the provisions of §§ 225-22 and 225-23 shall, upon conviction thereof, be subject to the following penalties:
A. 
First offense: a fine of $100.
B. 
Subsequent offense: a fine of $100 and up to 90 days of community service on such terms and in such form as the court shall deem appropriate.
A. 
Whenever snow has fallen and the accumulation is such that it covers the street or highway, no vehicle shall be parked on the main traveled or major roadways or portions thereof listed in Schedule IVA, § 225-30.

B. 
The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.
C. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary emergency no-parking signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of said emergency no-parking signs when weather conditions, accidents, fires or public celebrations dictate or require the avoidance of hazards or other conditions which interfere with the free flow of traffic.
D. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.
E. 
The effectiveness of this section is contingent on signs being erected as required by law.[1]

The Mayor is authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days or during specified hours on any day or days he finds that such closing is necessary for the preservation of the public safety, health or welfare.
Whenever streets are closed pursuant to this finding, the City shall post proper warning signs in both directions of traffic sufficient to warn motor vehicular traffic of the closing.

A. 
The hereafter described City street shall be declared to be one of limited public access, and that subject to the reservation of use by its police, fire, rescue, ambulance, water and sewer and street agencies and other services and agents in carrying out the police power functions in furtherance of the health and welfare of the citizens, said access shall be under the control and supervision of the City of Salem Port Authority.
B. 
Said control and supervision of public access include the prohibition of the free and unrestricted passage of motor vehicles and pedestrians over said described section of City street except in conjunction with the operation of the City of Salem Municipal Port Authority as well as the exercise of the essential police powers of the City of Salem as described above.
(1) 
The portion of Tilbury Road to be of said limited public access is more particularly described as follows: Beginning at a point in the center line of Tilbury Road, County Road Number 661, said beginning point being south fifty-three degrees, fourteen minutes west (S 53° 14' W) 90.00 feet from the center line of Grieves Parkway; thence (1) from said beginning point along the said center line of Tilbury Road north fifty-three degrees, fourteen minutes east (N 53° 14' E) 343.27 feet to a point of curvature; thence (2) continuing along the same on a curve, curving to the left described by a radius of 477.46 feet, an arc distance of 159.44 feet to a point of tangent; thence (3) continuing along the same north thirty-four degrees six minutes east (N 34° 6' E) 19.07 feet, to a point of curvature; thence continuing along the same on a curve, curving to the right described by a radius of 358.10 feet, an arc distance of 148.75 feet, to a point of tangent; thence (5) still along the same north 48.17 feet, to an angle point; thence (6) still along the same south seventy-eight degrees twenty minutes East (S 78° 20' E) 154.20 feet, to an angle point in the center line of West Broadway; thence (7) along the centerline of West Broadway south seventy-one degrees thirty-eight minutes east (S 71° 38' E) 530.14 feet, to a point in the northwesterly right-of-way line of Front Street (State Highway Route #49) and there to end.
C. 
This declaration of limited public access does not include the removal of a portion of the roadway, and the City of Salem Municipal Port Authority shall maintain the surface of said street as a public road or arrange with the City of Salem Street Department to do so.
D. 
The declaration of the above-described portion of Tilbury Road as one of limited public access shall be solely for the purpose of the operation of the City of Salem Municipal Port and for such period of time as it continues to so operate, and should the Municipal Port cease to operate as such, the limitation of public access shall terminate.

A. 
No-passing zones shall be established and maintained along Oak Street in the City of Salem, County of Salem, and State of New Jersey, as authorized by the New Jersey Department of Transportation on Sketch No. NPZ-3441, dated December 12, 1990.
B. 
No-passing zones shall be established and maintained along South Third Street - Third Street in the City of Salem, County of Salem, as authorized by the New Jersey Department of Transportation on:

(1) 
Grieves Parkway to 300 feet north of the center of Grieves Parkway, a distance of approximately 280 feet; and
(2) 
Seventy feet south of the center of Route NJ 49 to the eastbound curbline of Route NJ 49, a distance of approximately 50 feet.

A. 
The speed limits for both directions of traffic or in one direction where travel in one direction only is permitted shall be established as follows for the indicated streets:

B. 
Regulatory and warning signs shall be erected and maintained to effect the above-designated speed limits as authorized by the New Jersey Department of Transportation.

A. 
The Street Superintendent of the City of Salem be and hereby is authorized to establish restricted parking spaces in front of residences, schools, hospitals and other public buildings and in shopping and business districts within the City of Salem for use by handicapped persons who have been issued special vehicle identification cards by the Division of Motor Vehicles pursuant to the provisions of N.J.S.A. 39:4-205, when using a motor vehicle in which is displayed a certificate for which a special vehicle identification card has been issued, pursuant to N.J.S.A. 39:4-206.
B. 
The Street Superintendent of the City of Salem be and hereby is authorized to establish restricted parking zones for handicapped persons in front of residences occupied by handicapped persons, provided that:
(1) 
Such persons are holders of current drivers' license issued by this state;
(2) 
The motor vehicles to be parked in such zones are equipped with such special attachments and devices as the Director of the Division of Motor Vehicles may deem necessary to provide for the safe operation thereof by such persons; and
(3) 
Such parking is not otherwise prohibited and the permitting thereof would not interfere with the normal flow of traffic.
C. 
The Director of the Division of Motor Vehicles be and hereby is authorized to issue permits which identify a special motor vehicle and the location wherein it is to be parked for all restricted parking zones for handicapped persons established by Subsection B above. Such permits shall only be issued to persons who can prove ownership and operation of the motor vehicle and residency at the location specified thereon. The permit shall be five and one-half by eight and one-half (5 1/2 x 8 1/2) inches in size, shall bear an appropriate certification of authenticity and shall be displayed prominently within the vehicle when it is parked so as to be seen from the middle of the street. Only a motor vehicle for which a valid permit has been issued and which has such permit properly displayed shall be permitted to be parked in a restricted parking zone in front of a residence occupied by a handicapped person as indicated on such permit.

D. 
The term "handicapped person," as employed herein, shall include any person who has lost the use of one or more limbs as a consequence of paralysis, amputation or other permanent disability or who is permanently disabled as to be unable to ambulate without the aid of an assisting device or whose mobility is otherwise limited as certified by a physician with a plenary license to practice medicine and surgery or a podiatrist licensed to practice in this state or a bordering state.

E. 
No penalty under any law or municipal ordinance now in effect or hereinafter enacted shall be imposed for the parking overtime of any motor vehicle which has displayed thereon a placard or wheelchair symbol license plates issued pursuant to the provisions of N.J.S.A. 39:4-205 and 39:4-206 unless such vehicle shall have been parked in one location for more than 24 hours.
F. 
The provisions of this chapter are established in accordance with N.J.S.A. 39:4-197 et seq., and any part of this chapter inconsistent or in conflict with N.J.S.A. 39:4-197 et seq. is hereby repealed.

A. 
The Chief of Police is authorized and directed to designate and establish a restrictive parking space in the front of the residence of any handicapped individual who has been issued a vehicle identification card pursuant to the provisions of N.J.S.A. 39:4-205.
B. 
Said restrictive parking space may be used only by the motor vehicle of the qualifying handicapped individual residing at the dwelling located proximate to said space. The restricted handicapped parking locations are described in Schedule XI, § 225-37, being attached to and made a part of this chapter.
C. 
When a restrictive parking space is established, the Chief of Police will post the appropriate marking or sign at the space.
D. 
This section shall be deemed to be in addition and supplementary to and not in conflict with nor repeal of prior existing ordinances of this City but shall be an additional provision for the regulation of parking of those zones provided for herein.[1]

A. 
Removal authorized.
(1) 
The Police Department of the City of Salem is hereby authorized, in accordance with N.J.S.A. 39:4-139.13, to immobilize, remove or cause to be removed any vehicle found operating or parked on a public highway, in a municipal parking lot or on other property owned, leased or under the control of, or anywhere within the jurisdiction of the City of Salem where there are any outstanding warrants against such vehicle. In addition to or in lieu of removal, any such vehicle may be immobilized by use of a device or other mechanism which will cause no damage to such vehicle unless moved when such device or mechanism is in place. In any case involving immobilization of a vehicle pursuant to this section, there shall be placed on such vehicle, in a conspicuous manner, notice sufficient to warn any individual of the effect that any attempt to move such vehicle might result in damage to such vehicle.
(2) 
Any such vehicle so removed shall be impounded and stored in a place designated by the Police Department and shall be held until it is redeemed or disposed of pursuant to this chapter.
B. 
Sale of vehicle. If the outstanding warrants are not paid by 12:00 midnight on the 30th day following the day on which the vehicle was impounded or immobilized, the vehicle may be sold at a public auction, subject to and in accordance with the notice, publication and other provisions of N.J.S.A. 39:4-139.13.
C. 
Redemption prior to sale. At any time prior to the sale, the owner of the motor vehicle or other person entitled to the motor vehicle may reclaim possession of the motor vehicle upon payment of the costs of removal and storage of the motor vehicle, an administrative fee of $25 and any fine or penalty and court costs assessed against him for the violation that gave rise to the impoundment or immobilization of the motor vehicle and any outstanding warrants against the vehicle subject to and in accordance with the provisions of N.J.S.A. 39:4-139.13.
D. 
Proceeds from sale. Any proceeds obtained from the sale of a vehicle at public auction pursuant to Subsection B of this section in excess of the amount owed for the costs of removal and storage of the motor vehicle, the administrative fee, any fine or penalty and court costs assessed against him for a violation that gave rise to the impounding or immobilization of the motor vehicle and any outstanding warrants against the vehicle shall be returned to the owner of the vehicle, if his name and address are known.

A. 
Parking shall be prohibited in the Salem County parking lot, located in the block bordered by Market Street, Seventh Street, East Broadway and Grant Street, and also in the driveway from said parking lot to Market Street located between the Salem County Administration Building and the Salem County Court House, except that parking shall be permitted in spaces designated for that purpose.
B. 
Parking shall be further prohibited in places designated for the various county officials and officers by persons other than those to whom said spaces are designated, provided that vehicles permitted to park in said spaces shall be properly identified.

It shall be unlawful for the owner or operator of any vehicle to park such vehicle, between the hours of 8:00 a.m. to 5:00 p.m. Monday through Friday, except legal holidays, upon portions of the areas designated above where parking meters have been installed unless specific payment is made. The meters shall require one quarter for 15 minutes, subject to a maximum of two hours.
C. 
It shall be unlawful to park more than one vehicle of any description at any location in the City of Salem where a parking meter has been installed; that is to say, one vehicle shall be parked for each meter installation and no combination of vehicles such as motorcycles, motor bikes, miniature vehicles, wagons or any other self-propelled vehicle or vehicles shall be permitted except one such vehicle for each parking meter space. The owner or operator of a vehicle shall, immediately upon entering a parking space, deposit one or more coins of the United States, as designated, in the parking meter adjoining said parking space and turn the lever to cause the parking meter to operate. Failure to deposit the requisite coin or to turn the lever to operate shall constitute a violation of this section. No persons shall cause or permit a vehicle to remain in or to be parked in a parking space adjacent to any parking meter while such meter displays a signal indicating that the period of time prescribed for such parking space has expired. It shall be unlawful for any person to cause, allow, permit or suffer any such vehicle, registered in his or her name, to be parked adjacent to a parking meter in violation of this chapter. It shall be unlawful to park any vehicle across any line or marking designating a parking space, or to park said vehicle in any way that the same shall not be wholly within a parking space as designated by said markings. It shall be unlawful to deposit or cause to be deposited in any parking meter a slug or device or metallic substitute for a coin of the United States.

Any person who shall violate any of the provisions of this section and any person aiding, abetting or assisting in said violation shall, upon conviction thereof before the Judge of the Municipal Court of this municipality, be fined $35 together with costs of court, and in default thereof shall undergo imprisonment in the County Jail for a period not to exceed 10 days.

The two parking spaces at the end of the north side of the section of Hires Avenue between New Market Street and Walnut Street shall be restricted for use as bus parking only. Signage shall be prominently posted informing the public of the above parking restriction. Any person who shall violate the within parking restriction shall be fined $50.

In accordance with N.J.S.A. 39:5A-1 et seq., the provisions of Subtitle 1, Title 39, of the Revised Statutes shall be applicable in the following areas related to the Finlaw Building project area: parking garage off of Hires Avenue; surface parking lot off of Hires Avenue.

A. 
The hereafter described locations shall be permitted to serve as bus stops for omnibuses as defined by N.J.S.A. 39:1-1 as amended:
(1) 
Along Grieves Parkway, eastbound on the southerly side thereof at:
(a) 
Yorke Street, mid block beginning 250 feet easy of the easterly curbside of Yorke Street and extending 135 feet easterly thereof (past house number 427).
(2) 
Along Grieves Parkway, westbound on the northerly side thereof at:
(a) 
Yorke Street, mid block beginning 200 feet east of the easterly curbline of Yorke Street and extending 135 feet easterly thereof (between house number 414 and 420).
(3) 
Along Yorke Street, northbound on the easterly side thereof at:
(a) 
Magnolia Street far side beginning at the northerly curbline of Magnolia Street and extending 100 feet northerly therefrom (cemetery).
(4) 
Along Yorke Street southbound on the westerly side thereof at:
(a) 
Magnolia Street far side beginning at the southerly curbline of Magnolia Street and extending 100 feet southerly thereof (vacant house).
