For purposes of this article, the following definitions shall apply:
MINOR
Any person below the age of 21 years.
LICENSED PREMISES
Any bar, nightclub, lounge, hall or other facility which is the holder of any of the licenses referred to in § 75-1 of the Somers Point City Code.

No licensed premises shall advertise, promote, schedule or conduct any affair, show, dance or other form of entertainment directed at or designed specifically to attract minors.

A. 
Notwithstanding any other provisions of § 75-12.2 of this Code, upon application, the Council of the City of Somers Point may issue a special permit to a licensed establishment for a single event, which will include the exact date(s) and time of the event, hosted by any bona fide fraternal, charitable, religious or educational organization that desires to sponsor any affair, show, dance or other form of entertainment to be designated in said permit.
B. 
As a condition of issuance of said permit under this chapter, the applicant must demonstrate the ability to provide adequate security and chaperones for the duration of any activity to be held. Such application shall be referred to the Chief of Police who shall have the discretion to determine whether the requirements and intent of this chapter have been satisfied.
C. 
As a condition of issuance of said permit, the licensed establishment shall agree to suspend the sale of alcohol in the room of the licensed premises that will be accommodating the event which gave rise to the application for the temporary permit. Alcoholic beverages shall not be visible to underaged participants in the area where the event is held.
The applicant shall be charged a fee of $50 for the permit referenced herein. At the discretion of the City Council, said permit fee may be waived in part or in full.
The purchase or attempted purchase of alcoholic beverages by any person under the age of 21 years of age, whether the same is to be consumed on the premises or not, is hereby prohibited, and any person violating this section shall be deemed a disorderly person.
A. 
Any person under the age of 21 years of age who shall attempt to purchase or purchase any alcoholic beverages in the City of Somers Point by the use of false documents or representations shall be deemed a disorderly person.
B. 
Any person under the age of 21 years of age who shall have in his or her possession any altered or false document or documents for the purpose of identification and/or establishing the age of said person shall be deemed a disorderly person.
Any person who misrepresents his or her age to any police officer or special officer of the City of Somers Point in connection with the purchase and/or consumption of any alcoholic beverages shall be deemed a disorderly person.
Any person who shall permit the use of his or her documents by any person under the age of 21 years of age for the purpose of securing the purchase of alcoholic beverages in the City of Somers Point shall be deemed to be a disorderly person.

Any person who shall be charged with a violation of any of this article shall be tried by the Municipal Judge and, upon conviction thereof, shall be subject to a fine not exceeding $1,000 or a term of imprisonment not exceeding 90 days or a period of community service not exceeding 90 days, or any combination of the foregoing.
