GENERAL REFERENCES
Zoning — See Ch. 170.
This chapter applies to all principal buildings within the Township
of Westtown, Chester County, and each tract, lot or parcel of land.
As used in this chapter, the following terms shall have the
meanings indicated:
A subordinate building, the use of which is customarily incidental
to that of the principal building, used for an accessory use and located
on the same lot as a principal building.
Any building or structure erected on a tract, lot or parcel
of land on which any use is carried out, except an accessory building;
including a dwelling, place of business or industry, or any other
use requiring a location identity.
A.
The Board of Supervisors or its designee shall have the power to
assign street address numbers to each lot and to each dwelling unit
and commercial or business establishment where there is more than
one such dwelling unit or establishment on a lot.
B.
The Board of Supervisors or its designee shall have the power to
correct any errors with respect to the assignment of street address
numbers, as and when such errors are discovered, and shall have the
power to change and redesignate a street address number or numbers
assigned to any lot, dwelling unit or commercial or business establishment
when it is deemed that such change or redesignation is necessary or
desirable in order to provide street address numbers appropriate for
the purposes of uniquely identifying each lot, dwelling unit or commercial
or business establishment.
The owner or occupant of a lot, building, dwelling unit or commercial
or business establishment to which no street address number has been
previously assigned shall, prior to occupancy thereof, make application
to the township for assignment of such street address number.
The designated street address number shall be posted on each
building, dwelling unit or commercial or business establishment or
its associated mailbox in accordance with the following specifications
and regulations:
A.
If the principal building is served by a mailbox mounted at the end
of the access drive, the designated street address number shall be
posted on both sides of the box or post.
B.
If the street address number is not visible as described in Subsection A above and there is no mailbox located at the access drive, the street address number must be posted on a marker placed at the driveway entrance.
C.
If an access drive serves more than one principal building the street
address numbers shall be posted at the end of drive and auxiliary
numbers shall be posted to identify the main entrance to each structure
and/or dwelling unit.
E.
The numbers shall be so designed as to be readily legible and visible
during daylight hours by a person possessing normal vision from the
center lines of the facing street, and shall be placed so that trees,
shrubs and other obstructions do not block the line of sight of the
numbers from the center of the facing street to any appreciable degree.
A.
The absence of street numbers, or the insecure fastening or absence
of any numeral thereof, or the use of any street address number not
assigned by Westtown Township, or the failure of a street address
number to meet the visibility requirements shall be a violation of
this chapter. Upon discovery of such violation, a notice of violation
shall be sent by certified mail to the property or occupant, or shall
be personally served on the property owner or occupant or his agent.
Such notice shall specify the specific provision of the chapter violated
and shall require compliance with the provisions of this chapter within
15 days from the date of the notice.
B.
Any person who violates or permits a violation of this chapter shall,
upon conviction in a summary proceeding brought before a District
Justice under the Pennsylvania Rules of Criminal Procedure, be guilty
of a summary offense and shall be punishable by a fine of not more
than $1,000, plus costs of prosecution. In default of payment thereof,
the defendant may be sentenced to imprisonment for a term not exceeding
90 days. Each day or portion thereof that such violation constitutes
or is permitted to continue shall constitute a separate offense, and
each section of this chapter that is violated shall also constitute
a separate offense.
C.
After the issuance by Westtown Township of a notice of violation
of the provisions of this chapter, each day such violation shall continue
shall be deemed a separate offense subject to a like fine and penalty.
The Zoning Officer, or his designee, shall have the authority
to enforce this chapter.
