A certain document, being marked and designated as the "BOCA
International Plumbing Code, 1995," as published by the Building Officials
and Code Administrators International, Inc., be and is hereby adopted
as the Plumbing Code of the Township of Westtown in the County of
Chester, State of Pennsylvania, regulating the design, construction,
quality of materials, erection, installation, alteration, repair,
location, relocation, replacement, addition to, use or maintenance
of plumbing systems in the Township of Westtown, providing for the
issuance of permits and collection of fees.
The following sections are hereby revised as follows:
A.
Section 101.1 Title. That these regulations shall be known as the
"Plumbing Code of Westtown Township."
B.
Section 106.5.2 Fee Schedule. The permit fees for all plumbing work
shall be as determined by the Board of Supervisors of Westtown Township.
C.
Section 106.5.3: eliminated in its entirety.
D.
Section 108.4 Violation penalties. Any person who violates or permits
a violation of this code shall, upon conviction in a summary proceeding
brought before a District Justice under the Pennsylvania Rules of
Criminal Procedure, be guilty of a summary offense and shall be punishable
by a fine of not more than $1,000, plus costs of prosecution. In default
of payment thereof, the defendant may be sentenced to imprisonment
for a term not exceeding 90 days. Each day or portion thereof that
such violation continues or is permitted to continue shall constitute
a separate offense, and each section of this code that is violated
shall also constitute a separate offense.
E.
Section 108.5 Stop-Work Orders.
Any person who shall continue any plumbing work in or about
the structure after having been served with a stop work order, except
such work as that person is directed to perform to remove a violation
or unsafe conditions, shall be guilty of a summary offense and shall
be punishable by a fine of not more than $1,000, plus costs of prosecution.
In default of payment thereof, the defendant may be sentenced to imprisonment
for a term not exceeding 90 days. Each day or portion thereof that
such violation continues or is permitted to continue shall constitute
a separate offense, and each section of this code that is violated
shall also constitute a separate offense.

Section 306.6.1 Sewer Depth.
Building sewers that connect to private sewage disposal systems
shall be a minimum of 24 inches below finished grade at the point
of septic tank connection. Building sewers shall be a minimum of 36
inches below grade.

A.
Plumber's license. No person shall engage in the practice of
plumbing, either on his own behalf or on behalf of another, either
as a master, journeyman or apprentice plumber, without first securing
a license from the Township Plumbing Official. A resident of Westtown
Township who is not a plumber of any of the foregoing classes, who
is not engaged in the practice of plumbing as an occupation and who
limits his plumbing work to his own property within the township shall
not be required to secure a license.
B.
Application for license. Any person desiring to secure such license
shall make application on forms prepared and provided by the township,
and before a license is issued, the Township Plumbing Official shall
determine that the applicant is competent and qualified to practice
plumbing on the level of the license for which he/she is making application
and that, to the extent required by the township, the applicant is
familiar with the provisions of the Plumbing Code. Any conviction
for violating the Plumbing Code or any rule or regulation promulgated
thereunder shall be taken into consideration in determining whether
or not the applicant is competent and qualified.
C.
Terms of license, transferability, fees and penalties.
(1)
Every license issued by the plumbing official shall be for a period
ending on the 31st day of December next following, and licenses shall
not be transferable. The fee for each such annual license and for
each annual renewal shall be as set from time to time by resolution
of the Board of Supervisors, and shall be paid to the Plumbing Official
before any license or renewal thereof is issued.

If a license is not applied for on or before January 1 of each year
or within 30 days after the applicant has practiced as a competent
and qualified plumber, a penalty of 10% of the license fee shall be
imposed for each month thereafter, provided that in no case shall
the penalty exceed the amount of the license fee.
D.
Offenses. The practice of plumbing on each separate job by an unlicensed
person shall constitute a separate offense.
E.
Plumbing business. Every person engaged in the business of plumbing
shall employ only licensed plumbers, except that apprentices, helpers
and laborers may be employed where all of their work is supervised
by one or more licensed plumbers.
F.
Reciprocity. The Plumbing Official may grant a license upon payment
of the stated fees, without examination, to a holder of a substantially
equivalent license from another jurisdiction, upon satisfying himself
that the standards and qualifications required by the other jurisdiction
are substantially equivalent to those required by Westtown Township.
G.
Use of licensee's name by another. No person who has obtained
a plumber's license shall allow his name to be used by another
person, either for the purpose of obtaining permits or for doing business
or work under the license.
H.
APPRENTICE
JOURNEYMAN
MASTER
As used in this section, the following terms shall have the meanings
indicated:
A person who begins his apprenticeship between the ages of
16 and 40 years, who is engaged in learning the plumbing trade by
working with and assisting a journeyman or master plumber in the installation,
maintenance and repair of plumbing and drainage; and who is covered
by an apprenticeship committee.
Any person, other than a master or apprentice plumber, who
has demonstrated to the Plumbing Official his practical knowledge
of the installation of plumbing and has been licensed by the Board
to install plumbing under the direction of a master plumber.
A person who has demonstrated his skill in planning, superintending
and installing plumbing and who, having satisfied the Plumbing Official
to his knowledge of the rules and regulations governing the same and
as to his business integrity, has been granted a license as a master
plumber.
