GENERAL REFERENCES
Vehicles and traffic — See Ch. 213.
As used in this chapter, the following terms shall have the
meanings indicated:
Includes any light vehicle having two wheels, equipped with
or without pneumatic tires, propelled by pedals and operated by foot
action.
The Mayor or, under his direction, the Police Department is
hereby authorized and empowered to provide suitable supervision for
the issuance of all licenses and the maintenance of all necessary
records pertaining thereto, and said Mayor and/or Police Department
shall make a monthly report to the Council of the Borough of Lehighton
of all business transacted and fees collected and shall pay the same
monthly to the Borough of Lehighton.
A.
It shall be unlawful for any person or persons to operate or use
a bicycle upon any of the streets, alleys or public highways of the
Borough of Lehighton, Pennsylvania, without first obtaining a license
therefor and having said bicycle properly registered and tagged.
B.
The licensing and registration of bicycles shall be effective annually.
Application for a license shall be made to the Police Department
upon forms provided, which application shall contain the name, date
of birth and address of the owner, together with a description of
the bicycle sufficient for identification.

The annual license fee to be paid for each bicycle shall be
$1, to be paid in advance. Licenses may be transferred when the ownership
of said bicycle is transferred, and the fee for the registration of
said transfer shall be $1. Upon application and satisfactory evidence
of loss of a tag, a new tag will be issued upon the payment of $1.
Licenses from other communities shall be recognized, provided
that reciprocal relations exist between said communities and the Borough
of Lehighton.
No bicycle shall be registered or licensed until inspected,
examined and found to be in a safe machanical condition. Persons making
the inspection shall affix a license tag to each registered bicycle,
and the tag shall remain so affixed until registration is renewed
or removed for cause. All bicycles must bear a serial number, and,
if not, one shall be affixed.
It shall be unlawful for any person or persons willfully or
maliciously to remove, destroy, mutiliate or alter the number on any
bicycle frame pursuant to this chapter. It shall also be unlawful
for any person or persons to remove, destroy, mutilate or alter any
license plate, seal or registration card issued to any bicycle owner.
If any bicycle is found in any street or alley of the Borough
of Lehighton, Pennsylvania, without a license or identification tag
or with a broken seal or mutilated frame number, it shall be prima
facie evidence that said bicycle is being operated on the streets
of this borough without having been registered. Said bicycle shall
be immediately impounded and shall only be surrendered to the owner
thereof upon receipt of proof of ownership and payment of the license
registration fee hereinafter provided. If a bicycle which is impounded
as stated above shall remain unclaimed after 60 days, it may be sold
at public auction, and the proceeds from the sale shall revert to
the Borough of Lehighton, Pennsylvania.
B.
The Chief of Police is hereby authorized and directed to establish,
promulgate and enforce rules and regulations pertaining to the ownership
and operation of bicycles in furtherance of the purposes of this chapter.

Such rules and regulations shall not conflict with the provisions
of this chapter or the Vehicle Code.
(2)
Printed copies of such rules and regulations shall be given to each
bicycle owner at the time application is made for a license.
(3)
Any violation of said rules and regulations shall be deemed a violation
of this chapter, and the violator shall be subject to all enforcement
and penalty provisions set forth herein, including the impounding
of bicycles.
Registration cards shall be carried at all times and shall be
shown to any police officer on demand or when ordered to appear for
any violation of this chapter.
A.
Any person under 18 years of age who shall violate any of the provisions
of this chapter shall, upon the first offense, be officially reprimanded
in a letter addressed to such person's parents or guardians.
Such letter shall serve as official notice to such parent or guardian
of the violation of this chapter by the minor for whom they are responsible.
Upon a second or subsequent violation within a period of 12 months,
said person under 18 years of age shall be subject to proceedings
in Juvenile Court, and the parent or guardian of such person shall
be summoned to appear before the District Justice and may be fined
an amount not to exceed $600 and costs of prosecution and, in default
of payment of said fine and costs, to imprisonment for a term not
to exceed 30 days.[1]
B.
Any person 18 years of age or older who violates any of the provisions
of this chapter may, upon conviction by the District Justice, be subject
to a fine not exceeding $600 and costs of prosecution and, in default
of payment of said fine and costs, to imprisonment for a term not
to exceed 30 days.
C.
If any violation of any of the provisions of this chapter is also
a violation of a specific provision of the laws of Pennsylvania, such
violation shall be prosecuted as a violation of such law and not as
a violation of this chapter.
