If, at any time before or during the construction of the required improvements, it is demonstrated to the satisfaction of the Planning Board that unforeseen conditions make it necessary to modify the location or design of such improvements, the Board may authorize such modifications upon written request to the subdivider, provided that such modifications are within the spirit and intent of the Board's approval and the purpose of these regulations. Copies of the authorized modification shall be made part of the official record of the Board.
A. 
Routine inspections.
(1) 
The construction of all required improvements shall be inspected by the Village Engineer to ensure satisfactory compliance with applicable regulations.
(2) 
In no case shall any paving work be done without permission from the Village Engineer. At least three days' notice shall be given to the Village Engineer prior to such construction so that the Village Engineer may be present at the time the work is to be done.
(3) 
The Village Engineer shall be notified after each of the following phases of the work has been completed so that he may inspect the work:
(a) 
Road subbase.
(b) 
Curb forms.
(c) 
Road paving, after each coat in the case of priming and sealing.
(d) 
Sidewalk forms.
(e) 
Drainage pipe and other draining structures before backfilling.
B. 
Final inspections.

(1) 
A final inspection of all improvements and utilities will be made to determine whether the work is satisfactory and in substantial agreement with the approved final plat drawings. The general condition of the site shall also be considered. Upon a satisfactory final inspection report, action will be taken to release the performance security covering such improvements and utilities.
(2) 
If the Village Engineer shall find, upon inspection, that any of the required improvements have not been constructed in accordance with the plans and specifications filed by the subdivider, the subdivider will be severally and jointly liable for the costs of completing said improvements according to specifications. No plat which may be an extension or section of a previously recorded plat or no new plat, regardless of location, shall be approved by the Board if the subdivider has not fully complied with the construction of all the required improvements in a previously recorded plat submitted by him for approval.
(3) 
If the Village Engineer does not carry out an inspection of required improvements during construction, the subdivider shall not in any way be relieved of its responsibilities.
C. 
Inspection fee. An inspection fee, as determined by resolution of the Village Board of Trustees,[1] or performance as security shall be paid to the Village of Harriman prior to the time that the Chairman of the Planning Board signs the final plat to cover the costs of inspection. In the event that the actual cost of inspection amounts to less than the amount posted, the Village shall return the difference to the subdivider.
