No person shall make any fire or fires in any street, lane or alley or ignite or burn, or cause to be ignited or burned, within the Village of Phoenix any combustible waste materials, including leaves, grass, etc., unless such is placed in an incinerator constructed for such purpose and properly installed and equipped in conformity with all the laws, rules and regulations pertaining thereto or which may be hereafter adopted.
The burning of rags or garbage or any other substance creating noxious or foul odors is hereby prohibited.
A. 
Any person, firm or corporation violating any of the provisions of this chapter shall be liable to a fine of not more than $250 or imprisonment for up to 15 days, or both such fine and imprisonment.
B. 
Any person violating this chapter shall be liable to the penalty herein prescribed, to be prosecuted for and collected in the manner prescribed by law with costs of proceedings.
