The Town Board of the Town of Fulton hereby creates the position of Humane Officer, pursuant to the authority contained in § 173.03(1), Wis. Stats. Appointment of the Humane Officer shall be by the Town Board following nomination for the office by the Town Chairperson.
The Humane Officer of the Town of Fulton shall:
Enforce the provisions of § 95-21, Chapter 173, Chapter 174, and Chapter 951, Wis. Stats., which provisions are adopted herein by reference, as well as all other ordinances of the Town of Fulton relating to animals.
Have those powers granted to humane officers as set forth in Chapter 173, Wis. Stats.
Have the power to issue citations for violations of Town ordinances within the jurisdiction of the office of Humane Officer, as set forth in Subsection A.
The Town Chairperson or, in such officer's absence, his/her designee is designated as the official to review an abatement order issued by the Humane Officer. Such reviewing official may affirm, modify or withdraw an abatement order.
Any person named in an abatement order issued by the Humane Officer may, within the ten-day period following service of the order, request a hearing before the reviewing officer. The hearing shall be held within 10 days after the request is made, unless the requester agrees to a later date. The hearing shall be informal in nature.
Within 10 days after a hearing under Subsection B, the reviewing official shall affirm the order, modify and affirm the order, or withdraw the order.
Any person adversely affected by a decision of the reviewing officer under Subsection C may seek judicial review by commencing an action in Circuit Court within 30 days after the date the decision is issued.
