The definitions set forth in N.J.S.A. 4:19-15.1 et seq. are hereby adopted and incorporated by reference into this article, as if set forth fully herein.
Any person who shall reside in the Borough of Glen Gardner and who shall own, keep or harbor a dog of licensing age shall, in the month of January, apply for and procure form the Municipal Clerk or other official designated by the governing body in the Borough of Glen Gardner a license and official metal registration tag for each dog so owned, kept or harbored, and shall place upon each such dog a collar or harness with the registration tag securely fastened thereto. Persons applying for a dog license and registration tag shall pay the sum of $9.80 for the license plus such registration fees and additional charges as may be prescribed by law $1.20 for a total license fee of $11 for each neutered dog and $21 for each unneutered dog. In the event said license is applied for after February 1 of each year an additional late fee of $5 per month will be charged.
The Municipal Clerk or other official designated by the governing body of Glen Gardner to license dogs shall not grant any such license and official metal registration tag for any dog unless the owner thereof provides evidence that the dog to be licensed and registered has been inoculated with a rabies vaccine as specified in N.J.S.A. 4:19-15.2a and other state and federal laws and regulations concerning rabies vaccination.
A. 
Any person who keeps or operates or proposes to establish a kennel, a pet shop, a shelter or a pound in the Borough of Glen Gardner shall apply to the Borough Clerk or other official designated to license dogs for a license entitling him or her to keep or operate such establishment, in accordance with N.J.S.A. 4:19-15.8. License fees shall be as set forth in N.J.S.A. 4:19-15.9.
B. 
Operation of the above facilities shall be in conformity with "Rules and Regulations Governing the Sanitary Conduct and Operation of Kennels, Pet Shops, Shelters and Pounds," N.J.A.C. 8:23-3.1, and with other applicable state laws and regulations.
Any person appointed for the purpose by the governing body of the Borough of Glen Gardner shall annually cause a canvass to be made of all dogs owned, kept or harbored within the limits of the Borough of Glen Gardner and shall report, on or before May 1 of each year, to the Clerk or other person designated to license dogs in the Borough of Glen Gardner and to the local Board of Health and to the State Department of Health the result thereof, in accordance with N.J.S.A. 4:19-15.15.
No dog shall be permitted off the premises of the owner or the person keeping or harboring said dog, except on a leash, or on private property with the permission of the owner of such private property.
No person shall keep, harbor or maintain any dog which habitually barks or cries.
A. 
Any person appointed for the purpose by the governing body of the Borough of Glen Gardner shall take into custody and impound or cause to be taken into custody and impounded, and thereafter destroyed or disposed of as provided in N.J.S.A. 4:19-15.16 and other applicable laws and regulations of the State of New Jersey any dog found at large or otherwise in violation of this chapter.

B. 
If the owner or person keeping or harboring said dog shall claim the dog at the time of its detention, he or she shall pay to the Borough of Glen Gardner, in addition to the maximum maintenance fees set forth in the above statute, a pickup fee of $15 to cover the cost of the apprehension and transportation of each dog.
This article is enacted pursuant to "An Act for the Uniform Control and Licensing of Dogs and Kennels to Aid in Preventing the Spread of Rabies, etc., N.J.S.A. 4:19-15.1 through 4:19-15.29, as amended and revised, and state rules and regulations promulgated by the State Department of Health pursuant thereto, and other applicable state laws, rules and regulations.

Any person who violates or who fails or refuses to comply with any section of this article, except §§ 53-7 and 53-8, shall be subject to the penalties in N.J.S.A. 4:19-15.19. Any person who violates or fails to comply with §§ 53-7 or 53-8 shall be punishable by a maximum fine of $1,000; imprisonment for a term not exceeding 90 days; or a period of community service not exceeding 90 days.
