Because of changing markets for recyclable materials,
a long-term discussion on which solid waste materials should be designated
as recyclable is not possible. Therefore, please refer to Appendix
C and Appendix D of this article for a list of those materials which
are designated as recyclable.

Any violation of the provisions of this article
shall be punishable by a fine not exceeding $1,000, imprisonment for
a term not to exceed 90 days and/or a period of community service
not to exceed 90 days. Each day that the violation continues to exist
shall constitute a separate offense.

Each residence shall be permitted to place an unlimited number
of containers; however, each container shall be limited to a thirty-five-gallon
can with a weight limit not to exceed 50 pounds gross weight.

Subject to budgetary limitations, the pickup
of solid waste, other than recyclables, shall be provided to the residences
and commercial businesses in the Borough of Glen Gardner by the Glen
Gardner Sanitation Department, subject to the following rules and
regulations:
A. Pickup schedule. Regular pickup shall be weekly or
such other schedule as may be established by the Sanitation Department.
B. Permitted and prohibited materials. Solid waste to
be picked up by the Department shall be ordinary household garbage,
refuse or trash and other municipal solid waste (MSW). Under no circumstances
shall the Borough Sanitation Department pick up or dispose of the
following described materials, unless otherwise provided for in this
article:
(1) Construction or demolition materials.
(3) Liquid waste of any type.
(4) Hazardous, toxic, flammable or explosive materials.
(5) Dirt, sand, rocks, cement, concrete, bituminous concrete,
blacktop and similar materials.
(6) Lumber over three feet long.
(7) Auto frames, bodies or parts; engine parts or heavy
metal.
(9) Tree stumps, trunks, leaves, limbs or other vegetation.

Cardboard or paper products.
(13)
Recyclable materials, which shall be disposed
of in accordance with the Glen Gardner Recycling Regulations.

Any other materials prohibited by law or by
present or future regulation of the Borough of Glen Gardner.

All permitted materials shall be placed for
collection at curbside no earlier than 24 hours before scheduled pickup.
Materials shall be placed in appropriate containers that will prevent
spillage, such as standard trash cans or heavy-duty garbage bags.
A standard trash can shall be deemed as no greater than 35 gallons
in volume. The cleanup of any spillage of solid waste shall be the
responsibility of the residents producing the same.

Each residence shall be permitted to place up
to two thirty-five-gallon cans with a weight limit not exceeding 50
pounds' gross weight per container, or four heavy-duty plastic trash
bags not to exceed 30 pounds per plastic bag, of municipal solid waste
at curbside for collection. Additional cans or bags may be placed
at curbside with the use of stickers purchased from the Borough Clerk.

Dumpsters may be made available to residents by prior arrangements
with the Sanitation Clerk for a rental fee of $125 per load for a
three-cubic yard dumpster, payable in advance, for disposal of up
to three cubic yards of construction or demolition materials from
home renovations or for bulky household items. Recyclable materials,
including cardboard, may not be placed in dumpster. Sanitation Department
can refuse to pick up dumpster until recyclable materials are removed,
which may incur additional rental time and rental fees. Dumpsters
will be rented out for a two-week time period, at the end of which
the Sanitation Department will pick the dumpster up from the property.
Residents may request additional time for a fee of $75 for each additional
seven-day period. Such dumpsters shall not be available for use by
commercial contractors or builders. Under no circumstances shall such
material be placed for pickup by the Borough Sanitation Department
in other than a Borough dumpster paid for in advance to the Sanitation
Clerk.
Subject to budgetary limits, the Sanitation
Department shall collect garbage, trash and other municipal solid
waste (MSW) from commercial establishments, subject to the following
regulations:
A. No materials as prohibited in this article shall be
placed for collection or picked up.
B. Dumpsters up to three cubic yards of such materials
will be picked up from commercial establishments at no charge.
C. Commercial establishments not using a dumpster may
put out for collection up to two thirty-five-gallon containers, not
exceeding 50 pounds' gross weight per container, or up to four heavy-duty
plastic trash bags not to exceed 30 pounds per bag, per collection.

D. No prohibited materials shall be disposed of by any
commercial establishment through the Glen Gardner Sanitation Department.
Any person violating any of the provisions or
failing to comply with any of the mandatory requirements of this article
shall be subject, upon conviction, to one or more of the following:
A. A fine of not more than $1,000, imprisonment for a
term not exceeding 90 days, or a period of community service not exceeding
90 days, in the discretion of the Judge imposing the same.
