A.
The rules and regulations of this article are mandatory
for all occupants of residential, commercial and institutional establishments
located in the Borough of Glen Gardner.
B.
Any recyclable placed at the curbside for pickup or deposited at a residential complex depot shall be and become the property of the Borough of Glen Gardner or its authorized agent. It shall be a violation of this article for any person or company unauthorized by the Borough of Glen Gardner to collect or pick up or cause to be collected or picked up any such recyclable. Each such collection or pickup in violation hereof is an offense subject to a penalty as provided in § 139-6. Multiple collections or pickups are deemed multiple separate and distinct offenses.

C.
The provisions of this article may be enforced by
the Recycling Coordinator and/or the Recycling Enforcement Specialist
of Hunterdon County, the Municipal Building Code Official or a designated
officer of the Borough of Glen Gardner.
D.
No recyclable that is being collected as part of the municipal recycling program may be donated or sold to or received by any person, partnership or corporation (whether operating for profit or not for profit) unless said person, partnership or corporation has first received written authorization from the Recycling Coordinator of the Borough of Glen Gardner. Each such sale or receipt in violation hereof is an offense subject to a penalty as provided in § 139-6.

E.
The Recycling Coordinator of the Borough of Glen Gardner
is hereby authorized and directed to establish and promulgate reasonable
rules and regulations as to the recycling plan for the Borough of
Glen Gardner. The recycling plan shall include Appendices B, C and
D of this article.[1] Such rules and regulations shall be effective no earlier
than 30 days nor later than 90 days from the date of promulgation
and publication of said rules and regulations. The Mayor and Common
Council of the Borough of Glen Gardner may, by majority vote, change,
modify, repeal or amend any portion of said rules and regulations.

Because of changing markets for recyclable materials,
a long-term discussion on which solid waste materials should be designated
as recyclable is not possible. Therefore, please refer to Appendix
C and Appendix D of this article for a list of those materials which
are designated as recyclable.[1]

A.
Residential complexes are defined as single or multiple
dwellings designed for occupancy by more than four families.
D.
The owner of each residential complex is responsible
for providing a recycling depot for the entire complex. The depot
shall be equipped with owner- or contractor-supplied receptacles for
each category of designated recyclable material. Access to the depot
shall be controlled by the owner or his or her agent(s); however,
access to the depot for the families of the residential complex must
be scheduled at least once a week for at least a two-hour period,
and access to the depot must be made available to the recyclables
collector between 7:00 a.m. and 4:00 p.m. on collection days.
A.
Commercial, industrial and institutional establishments
are defined as all entities which will operate or conduct any business
whatsoever which cannot be included within the definitions of a residential
premises or complex.
C.
Commercial, industrial and institutional establishments
may be exempted from recycling all materials designated by Appendix
C and Appendix D[2] as "commercial, industrial and institutional recyclables,"
provided that at least one commodity is recycled. This exemption must
be applied for and approved by the Recycling Coordinator and must
be made in writing. Included with the request must be evidence showing
that the applicant will implement an individual establishment's alternate
recycling plan identifying the material(s) that will be recycled and
represents that an excess of 50% of the solid waste generated by the
applicant will be recycled. A temporary one-time three-month exemption
may be granted without supporting evidence at the discretion of the
Recycling Coordinator; however, at the end of the three-month period
the establishment must reapply for exemption with evidence collected
during the three-month period. All regular exemptions (nontemporary
exemptions) will expire on December 31 of each year. Exemptions must
then be reapplied for no later than January 31 of the next year.

D.
Designated recyclables as described in Appendix C
and Appendix D[3] must be delivered to a state-approved recycling facility
at least once a month. Weight slips detailing the date, type of recyclables
and the weight (in pounds or tons) must be delivered to the Borough
Clerk no later than the 15th of the month for the preceding month.

Any violation of the provisions of this article
shall be punishable by a fine not exceeding $1,000, imprisonment for
a term not to exceed 90 days and/or a period of community service
not to exceed 90 days. Each day that the violation continues to exist
shall constitute a separate offense.

Each residence shall be permitted to place an unlimited number
of containers; however, each container shall be limited to a thirty-five-gallon
can with a weight limit not to exceed 50 pounds gross weight.

Subject to budgetary limitations, the pickup
of solid waste, other than recyclables, shall be provided to the residences
and commercial businesses in the Borough of Glen Gardner by the Glen
Gardner Sanitation Department, subject to the following rules and
regulations:
A.
Pickup schedule. Regular pickup shall be weekly or
such other schedule as may be established by the Sanitation Department.
B.
Permitted and prohibited materials. Solid waste to
be picked up by the Department shall be ordinary household garbage,
refuse or trash and other municipal solid waste (MSW). Under no circumstances
shall the Borough Sanitation Department pick up or dispose of the
following described materials, unless otherwise provided for in this
article:
(1)
Construction or demolition materials.
(2)
Industrial waste.
(3)
Liquid waste of any type.
(4)
Hazardous, toxic, flammable or explosive materials.
(5)
Dirt, sand, rocks, cement, concrete, bituminous concrete,
blacktop and similar materials.
(6)
Lumber over three feet long.
(7)
Auto frames, bodies or parts; engine parts or heavy
metal.
(8)
Tires.
(9)
Tree stumps, trunks, leaves, limbs or other vegetation.
(10)
Cardboard or paper products.
(11)
Railroad ties.
(12)
Batteries.
(14)
Any other materials prohibited by law or by
present or future regulation of the Borough of Glen Gardner.

All permitted materials shall be placed for
collection at curbside no earlier than 24 hours before scheduled pickup.
Materials shall be placed in appropriate containers that will prevent
spillage, such as standard trash cans or heavy-duty garbage bags.
A standard trash can shall be deemed as no greater than 35 gallons
in volume. The cleanup of any spillage of solid waste shall be the
responsibility of the residents producing the same.

Each residence shall be permitted to place up
to two thirty-five-gallon cans with a weight limit not exceeding 50
pounds' gross weight per container, or four heavy-duty plastic trash
bags not to exceed 30 pounds per plastic bag, of municipal solid waste
at curbside for collection. Additional cans or bags may be placed
at curbside with the use of stickers purchased from the Borough Clerk.
A.
Stickers are required and shall be available from
the Sanitation Clerk's office for disposal of the following large
items, at a price to be set by the Sanitation Commissioner with the
approval of the Borough Council: mattresses, rugs, appliances, furniture,
furnishings and similar bulky household items. Tires may also be picked
up in limited quantities in the discretion of the Sanitation Department,
at a fee to be set as provided above.
B.
All appliances containing freon must have a certification
that the freon has been properly removed before it will be picked
up by the Sanitation Department. In the absence of such certification,
a fee in the amount of $25 shall be paid to the Borough Sanitation
Department to defray the cost of proper freon removal prior to placement
of said appliance for collection at curbside. A special sticker indicating
payment of the freon removal fee shall be affixed to the appliance
and proper removal of the freon shall then be the responsibility of
the Borough Sanitation Department. The Sanitation Department may reserve
the right to refuse pickup or freon removal of appliances from commercial
establishments, from nonresidents of the Borough, or to limit quantities
of appliances requiring freon removal.

Dumpsters may be made available to residents by prior arrangements
with the Sanitation Clerk for a rental fee of $125 per load for a
three-cubic yard dumpster, payable in advance, for disposal of up
to three cubic yards of construction or demolition materials from
home renovations or for bulky household items. Recyclable materials,
including cardboard, may not be placed in dumpster. Sanitation Department
can refuse to pick up dumpster until recyclable materials are removed,
which may incur additional rental time and rental fees. Dumpsters
will be rented out for a two-week time period, at the end of which
the Sanitation Department will pick the dumpster up from the property.
Residents may request additional time for a fee of $75 for each additional
seven-day period. Such dumpsters shall not be available for use by
commercial contractors or builders. Under no circumstances shall such
material be placed for pickup by the Borough Sanitation Department
in other than a Borough dumpster paid for in advance to the Sanitation
Clerk.
A.
The placing for collection, pickup or disposal of
any trash, solid waste or other material through or by the Glen Gardner
Sanitation Department other than as provided in this section is prohibited.
All ordinary household waste, trash and other municipal solid waste
(MSW) shall be placed at curbside in approved containers. No prohibited
material shall be placed for collection by the Borough Sanitation
Department, except designated materials placed in a borough dumpster
by prior arrangement.
B.
Nonresident waste prohibited. No person shall place
trash, solid waste or any other material described herein from outside
of the Borough of Glen Gardner for collection, pickup or disposal
by the Glen Gardner Sanitation Department, and no resident shall permit
or allow any person to place any such items from outside of the Borough
of Glen Gardner on, adjacent to or in front of the resident's premises
for pickup, collection or disposal by the Glen Gardner Sanitation
Department.
C.
Tampering or unauthorized removal prohibited. No scavenger
or other unauthorized person shall break into, untie, unbundle, open,
disturb, remove or scatter any waste, refuse or material where such
material has been placed for pickup, collection or disposal by the
Glen Gardner Sanitation Department.
Subject to budgetary limits, the Sanitation
Department shall collect garbage, trash and other municipal solid
waste (MSW) from commercial establishments, subject to the following
regulations:
A.
No materials as prohibited in this article shall be
placed for collection or picked up.
B.
Dumpsters up to three cubic yards of such materials
will be picked up from commercial establishments at no charge.
C.
Commercial establishments not using a dumpster may
put out for collection up to two thirty-five-gallon containers, not
exceeding 50 pounds' gross weight per container, or up to four heavy-duty
plastic trash bags not to exceed 30 pounds per bag, per collection.

D.
No prohibited materials shall be disposed of by any
commercial establishment through the Glen Gardner Sanitation Department.
Any person violating any of the provisions or
failing to comply with any of the mandatory requirements of this article
shall be subject, upon conviction, to one or more of the following:
A.
A fine of not more than $1,000, imprisonment for a
term not exceeding 90 days, or a period of community service not exceeding
90 days, in the discretion of the Judge imposing the same.
