Any person, party or corporation seeking to dig a trench or ditch along or across a municipal road or street within the Borough of Glen Gardner for the purpose of laying pipes, wires or any other purposes shall first apply to the Clerk of the Borough of Glen Gardner for a permit.

Such permit shall be accompanied by a certified check payable to the Borough of Glen Gardner in the sum of $150 for a trench which crosses in whole or in part any municipal street or road or any street or road maintained by the Borough of Glen Gardner, and in the sum of $2 per lineal foot of trench for any trench along a municipal street or road or along any street or road maintained by the Borough of Glen Gardner.
At the expiration of 90 days from the completion of the filling of such trench, the Road Supervisor shall make an inspection to determine whether the roadway has settled so as to require additional work on the part of the applicant. If, however, the Road Supervisor finds that the roadway has been returned to a condition which is substantially the same, or better, as compared with its condition prior to the road or street opening, he or she shall so inform the Clerk of the borough, in writing, and the Clerk shall forthwith return the check or deposit to the applicant.
The Borough Council may by resolution apply the funds representing said check or deposit toward putting said roadway into proper condition if, at the end of the ninety-day period aforementioned, together with the expiration of an additional period of 10 days, the applicant has not returned the roadway to a satisfactory condition.

Any person, party or corporation failing to obtain a permit before starting a street or road opening shall be punishable by a fine not exceeding $1,000, imprisonment for a term not to exceed 90 days and/or a period of community service not to exceed 90 days. Each day that the violation continues to exist shall constitute a separate offense.
