This Article is enacted to establish rules and
regulations for the protection, care and control of the John L. Hogan
Memorial Park, Veterans Park, playgrounds or municipal properties
in the Borough of Northvale and to regulate the conduct of persons
on or within such parks, playgrounds or municipal properties or using
the facilities thereof.[1]

No person shall:
A.
Cut, break, deface, defile or misuse any building
or playground equipment, fence, tree, bush, plant or turf or other
thing belonging to the parks, playgrounds or municipal properties
or any part thereof.
B.
Destroy, remove or carry away or have possession of
any building or playground equipment, fence, tree, bush, plant, turf
or other thing belonging to the parks or playgrounds or other municipal
properties or any part thereof.
A.
No person shall ride a bicycle in any parks or athletic
field except upon a path or paved area nor in such a manner as to
interfere with another's enjoyment of the facilities of the parks
or playgrounds.
B.
No person, except an authorized member or employee
of the Department of Recreation or Department of Public Works, shall
drive any motor vehicle, wagon or cart upon paths, driveways or roadways
within any parks, playgrounds or municipal properties.[1]
C.
No person shall coast with a sled, cart or other vehicle
in the parks, playgrounds or municipal properties except in places
especially designated therefor by the Department of Recreation.
No domestic animals or fowl shall be allowed
to run at large on or within the parks, playgrounds or municipal properties.
Any person who takes a dog into the parks, playgrounds or municipal
properties shall hold it with a leash and shall not permit the dog
to commit a nuisance by defecating anywhere within the parks, playgrounds
or municipal properties.
No person shall drop, place or throw any paper
or other refuse anywhere in the parks, playgrounds or municipal properties
except in a receptacle provided for refuse.
No person shall erect or occupy any tent, stand
or other structure in the parks, playgrounds or municipal properties
or sell or give away from any such tent, stand or other structure
any food, drink or other thing without the written permission of the
Mayor and Council.
Both parks will close 30 minutes after sundown
and open 30 minutes after sunrise.
No person shall make any fire within the parks,
playgrounds or municipal properties except at such places as may be
designated by the Department of Recreation and only under such conditions
and restrictions as may be prescribed by said Department.
No person on or within the aforementioned parks,
playgrounds or municipal properties shall:
A.
Throw a stone or other missile.
B.
Sell, expose for sale or give away goods, wares or
circulars or post or display any sign, placard or advertising device.
C.
Play, engage or take part in any game or competitive
sport for money or other valuable thing without authorized permission
by the Mayor and Council.
D.
Unless authorized by law, discharge or have possession
of any firearm.
E.
Solicit alms or contributions for any purpose without
the written permission of the Mayor and Council.
F.
Individually or as part of a group, preach or make
any harangue, sing, play a musical instrument or conduct a civic parade,
drill or procession without written permission of the Mayor and Council.

A.
The Borough may act to temporarily close or limit the use of parks, and recreational facilities, including (but not limited to) municipal and Board of Education fields and lots, whenever, in the judgment of any of the appropriate enforcing authorities, as defined in Chapter 135 of the Code of the Borough of Northvale, such action is deemed necessary or desirable for the protection of public health or safety.
B.
As used in this section, the term "lightning risk warning" shall
mean notice to the Borough of a lightning risk, the activation of
the lightning warning system siren or strobe or the happening of any
event deemed by any of the appropriate enforcing authorities to be
a risk to health and safety due to lightning.
C.
If a lightning risk warning occurs, all parks and recreational facilities
will be closed, including (but not limited to), municipal and Board
of Education fields, lots and other areas.
D.
If a park or recreational facility is closed, as provided in this
chapter:
(1)
All activities within such park or recreational facility shall
immediately cease until the lightning warning system provides the
all-clear sound or any of the appropriate enforcing authorities authorizes
the facility(ies) to re-open; and
(2)
All persons within the park or recreational facility when the
lightning risk warning occurs shall immediately exit the park or recreational
facility and not return until the lightning warning system provides
the all-clear sound or any of the appropriate enforcing authorities
authorizes the facility(ies) to re-open. "All persons" shall include
all employees of the Borough of Northvale, volunteers, coaches, team
members and their families and umpires/referees as well as all members
of the public.
E.
Organized activities.
(1)
The person or persons seeking issuance of such a permit shall
be responsible to ensure all coaches, umpires, referees, and/or coordinators
shall sign the Borough of Northvale lightning safety policy.
(2)
The umpire, coach, coordinator or adult in charge is responsible
to ensure that their group follows the lightning safety policy. Disregarding
the policy subjects the umpire, coach, coordinator and adult in charge
to a suspension, up to and including a lifetime suspension, from all
Northvale recreation activities and privileges, including using the
fields and parks for organized activity.
F.
Unorganized activities. Members of the public informally using the
parks, fields, lots or other facilities are also subject to the terms
of this chapter.
The provisions of this Article or any other
ordinances shall not be deemed to affect the rights of those persons
availing themselves of the rifle range facilities or ice-skating rink
located at John L. Hogan Memorial Park.

A.
If the Code of the Borough of Northvale provides for the licensing
or permitting of any person or entity who/which violates the terms
of this chapter, the Mayor and Council of the Borough of Northvale
reserves the right to revoke such permit or license.
B.
Any person or entity found guilty of violating this chapter of the
Code of the Borough of Northvale shall be subject to a penalty consisting
of a fine not to exceed $500.

Members of the Police Department of the Borough of Northvale,
members of the Northvale Fire Department, designated agents of the
Parks and Recreation Department and the Mayor and Council shall be
the "enforcing authorities" authorized to enforce he terms of this
chapter.

As used in this Article, the following terms
shall have the meanings indicated:
An annual fee collected by the Recreation Committee and paid
by it to the Treasurer of the Borough of Northvale, which fee shall
be such amount as is determined by the Mayor and Council herein and
by any subsequent amendments to this Article, as is directly related
to the increased costs incurred as a result of the regular recreational
use of the athletic fields.
The athletic fields located at John L. Hogan Memorial Park
and Veterans Park.
Any person or persons, firm, corporation or other entity
that makes use of the recreational facilities of the Borough of Northvale
on a scheduled basis during a given season, such schedule having been
authorized and approved by the issuance of a permit by the Recreation
Committee of the Borough of Northvale.
A field maintenance charge in the amount of
$7.50 per team, per scheduled game, is hereby imposed upon all regular
users of the recreational facilities of the Borough of Northvale for
softball purposes. Such charge shall be paid by the regular user at
the beginning of the season at the time that the permits are issued
and the schedule is approved by the Northvale Recreation Committee.
A.
The Mayor and Council hereby authorize the Northvale
Recreation Committee to issue permits to all regular users of the
recreational facilities for the purpose of softball games. Such permits
shall be in a form approved by said Recreation Committee and shall
indicate thereon the dates and times that the applicant is permitted
to utilize the recreational facilities.
B.
No regular user, defined herein, shall utilize the
recreational facilities of the Borough of Northvale for the purposes
of softball competition after the effective date of this Article unless
they have first obtained a permit from the Northvale Recreation Committee.
