No person or persons, firm or corporation shall maintain or operate
a pool, billiard or snooker table in any public room or place where a charge
is made for the use of the same, and no person or persons, firm or corporation
shall maintain, operate, conduct or pursue the business or occupation of keeping
any public room or place wherein games commonly known as "pool" or "billiards"
are played without having first obtained a license therefor from the Mayor
and Council of the Borough of Northvale as hereinafter provided.
An application for the license in § 144-1 hereof shall be filed with the Borough Clerk, in writing, and shall contain the following information:
A.
The name and address of the applicant.
B.
In the case of a partnership, it shall state the names
and addresses of all partners.
C.
In the case of a corporation, it shall state the names
and addresses of officers, directors and stockholders presently holding stock
and the names and addresses of all persons who have, for six months prior
to the date of said application, been officers, directors or stockholders.
D.
Whether or not any person or persons named in the application
have ever been convicted of a violation of any federal, state or municipal
law.
E.
The location of the premises to be licensed.
F.
The number of pool, billiard or snooker tables to be
located on the premises to be licensed.
All said licenses shall be issued by the Borough Clerk only after a
resolution of the Mayor and Council of the Borough of Northvale shall have
been adopted approving said application and only after the payment of the
license fees hereinafter set forth. The license shall be from September 1
of the year of issuance until August 31 of the next ensuing year. Licenses
may be issued for a period of less than a year, but all licenses shall expire
on August 31 of each year.
A.
Such license shall bear the date of issue, the name of
the licensee and the location of the room or building wherein the licensee
is authorized to operate a table or carry on or conduct a pool or billiard
business.
B.
Such license shall not be transferred by the holder to
any other person, firm or corporation or to any other address without written
application first being made for such transfer to the Borough Clerk and such
transfer being approved by resolution of the Mayor and Council of the Borough
of Northvale.
A.
The Mayor and Council of the Borough of Northvale may
suspend or revoke the license of any licensee on any one or more of the following
grounds:
(1)
Violation of any of the laws of the State of New Jersey
upon the licensed premises by the licensee or its agents, servants, employees
or representatives.
(2)
Violation of any ordinance of the Borough of Northvale
upon the licensed premises by the licensee or its agents, servants, employees
or representatives.
(3)
If said license was procured by fraudulent conduct or
false statement of a material fact, or if a fact concerning the applicant
was not disclosed at the time of filing the application where such fact would
have constituted just cause for refusing to issue said license.
(4)
Permitting or suffering any activity upon the licensed
premises which is or may be detrimental to the public health, safety, welfare
or morals.
B.
In all such cases, written notice of the charge or charges
and the time and place of hearing thereon shall be served on the licensee,
either in person or by certified or registered mail addressed to the licensed
premises. No revocation or suspension shall occur unless the licensee shall
have been afforded an opportunity to be heard in his defense.
In the event that any license is suspended or revoked, the licensee
shall not be permitted the return of any portion of the license fee.
Every establishment wherein the primary function of said establishment
is the conduct or operation of a pool or billiard room shall be closed between
the hours of 12:00 midnight and 10:00 a.m. on weekdays and from 1:00 a.m.
to 1:00 p.m. on Sundays. In any establishment wherein the operation of a table
or tables is not the primary function of said business and the table or tables
is merely an adjunct to the operation of said establishment, then and in that
event the hours of closing shall be similar to those governing all plenary
retail consumption liquor licensees in the Borough of Northvale.
No person under the age of 18 shall be permitted to play pool or billiards
in any licensed premises or to frequent, lounge, congregate or gather in such
premises unless accompanied by his or her parent or guardian, and provided
further that such person may frequent said premises without violating any
other municipal, state or federal law. Notification of the provisions of this
section shall be conspicuously posted in any establishment licensed under
this chapter.
This chapter shall not apply to any religious, charitable, benevolent
or nonprofit association or corporation which operates or maintains any pool
or billiard table solely for the recreation or amusement of its members, provided
that such organization is bona fide in character and is not intended as a
means or device for evading the terms and provisions of this chapter, nor
shall this chapter apply to the keeping of any pool or billiard table in private
residences.
The license herein described shall conspicuously be posted and displayed
in any premises licensed under this chapter.
