Whenever the Northvale Planning Board or Board of Adjustment shall approve any development for which the execution of a developer's agreement is required, the developer or his authorized agent or representative shall make written request (copy to the Borough Clerk) to and obtain from the Borough Engineer a site work permit. No work shall be performed, including but not limited to demolition or site clearance, until the site work permit is issued.

A. 
No person or entity shall request a site work permit unless the following prerequisites are first complied with:
(1) 
The developer must sign the developer's agreement in triplicate and return all copies to the Borough Clerk.
(2) 
The developer shall post through the office of the Borough Clerk the required legal and engineering escrows; monument fees; submission fees; performance guaranty; certificate of insurance; deed(s) of easement, if required; and any other item required by the developer's agreement and Board of Adjustment or Planning Board or Borough Attorney resolution.
B. 
The Borough Clerk shall notify the Borough Engineer when all requirements of Subsection A hereof have been met.
C. 
Upon receipt of notification of the Borough Clerk and receipt of the site work permit fee, the Borough Engineer shall issue a site work permit in a form prepared by the Borough Engineer.
Every individual or entity seeking a site work permit shall pay a nonrefundable fee of $20 to the Borough of Northvale along with the request for a site work permit and deliver the fee to the Borough Clerk along with the copy of the request permit.
This chapter shall be enforced by the Zoning Officer and Police Department of the Borough of Northvale.
A. 
Any person or persons who violate this chapter shall, upon conviction for each and every violation thereof, be subject to a fine of not more than $1,000 or to imprisonment for a period not exceeding 90 days, or to both, in the discretion of the Municipal Court Judge before whom each conviction is adjudged. Whenever such violation shall continue for more than one day, each day of continued violation shall be considered a separate violation of this chapter. The principals of corporate entities shall be construed as "persons" hereunder.
B. 
In addition to the penalty set forth in Subsection A of the section, the Zoning Officer may issue a notice of violation and orders to terminate, directing discontinuance of the illegal action or condition and correction of the violation.
