In order to promote the health, safety and welfare of the citizens of the Borough of Northvale, dumps are hereby declared to be nuisances, hazardous to human health.

It shall be unlawful in the Borough of Northvale for any person to throw, dump, place or scatter or permit or cause to be thrown, dumped, placed or scattered any garbage, trash, debris or waste material substance of any nature or character on any public or private property not his own within the Borough of Northvale. Excluded from this provision shall be the disposal of any recyclables as defined by local ordinances and/or state statute.
It shall be unlawful for any person, firm or corporation, whether an owner, tenant or otherwise, to accumulate, permit or allow the accumulation of garbage, trash, debris or any waste material substance or thing of any kind or character upon his or her property, but he or she shall promptly place the same for removal by a trash or garbage collector.

Any person, firm or corporation, whether acting as principal, agent or employee, violating any provisions of this article shall, upon conviction thereof before any court having jurisdiction, pay a penalty of not less than $100 and not more than $1,000, in the discretion of the Judge before whom such conviction shall be had. In addition, the Judge, at his discretion, may impose a sentence of community service and/or a term of up to 90 days in the county jail. Each day that a violation shall continue shall constitute a separate offense.[1]
