The restrictions upon and the regulations governing the operation
and maintenance of snowmobiles within the limits of the Borough of
Washington are hereby established for the purpose of promoting public
safety and convenience and for the purpose of preserving and caring
for the health, safety and general welfare of the inhabitants of and
visitors to the Borough of Washington, in that the widespread use
and operation of snowmobiles in the Borough creates a condition that
causes distractions which endanger the safety, convenience and general
welfare of the inhabitants of the Borough and of visitors thereto.
For the purpose of this article, the terms used herein are defined
as follows:
A device consisting of a series of chambers or baffle plates
or other mechanical design for the purpose of receiving exhaust gas
from an internal-combustion engine and effective in reducing noise.
An automotive vehicle designed for travel over snow or ice,
supported by skis or runners and propelled by a traction belt or wheel.
It shall be unlawful to operate snowmobiles in violation of
the regulations hereinafter set forth:
A.
All snowmobiles operated on private property within the limits of
the Borough of Washington shall be maintained in a safe condition.
B.
Operation of snowmobiles on public streets or highways is forbidden.
C.
All snowmobiles operated on private property shall be properly muffled
in accordance with the requirements applicable to passenger automobiles.
D.
No snowmobile shall be operated within the Borough limits so as to
create excessive noise. Excessive noise shall specifically include
the unnecessary acceleration of the engine and any other loud, unnecessary
or unusual noise which disturbs and interferes with the peace and
quiet of other persons.
E.
No snowmobile shall be operated within the Borough limits in a careless,
reckless or negligent manner so as to endanger the safety of any person
or property of any other person.
F.
No snowmobile shall be operated on private property within the Borough
limits without the consent or permission of the owner or occupant
of said property, except that arrest under this subsection shall be
subject to said occupant's or owner's filing of a sworn
complaint prior to arrest.
G.
The operation of snowmobiles is hereby prohibited in any public park
or public property within the limits of the Borough of Washington.
H.
No person under the age of 17 years shall operate a snowmobile within
the Borough of Washington.
Any person violating any of the provisions of this article shall
be punished, upon conviction, by a fine not exceeding $500 for each
violation or by imprisonment for a term not to exceed 90 days, or
by both such fine and imprisonment. Each day that a violation or failure
to comply with any provision of this article or any regulation promulgated
hereunder by the Mayor and Council occurs shall constitute a separate
and distinct violation.
