It shall be unlawful for any person to operate or participate in the
operation whether as owner, proprietor or employee of any establishment of
the type commonly known as "massage parlor," "massage salon" or "bath parlor"
if any physical contact with the recipient of the massage, bath or similar
services is provided by a person of the opposite sex.
This chapter shall not apply to a physician, surgeon, chiropractor,
osteopath or physical therapist duly licensed by the State of New Jersey,
or to a licensed nurse acting under the direct prescription and direction
of any such physician, surgeon, chiropractor or osteopath, nor shall it apply
to barber shops or beauty parlors in which massage is given to the scalp,
face, neck or shoulders.
