[Local Law No. 3-2010, adopted 2-17-2010, established a six-month moratorium on the grant of permits and permission for new connections or hookups to the Village of Lake George Sewage Treatment System. Said moratorium expired six months from the date of adoption of L.L. No. 3-2010.]

The purpose and intent of this article is to adopt a moratorium on certain sanitary sewer connections in the Village of Lake George. The Village of Lake George is currently evaluating improvements to its wastewater treatment facilities, and the Board of Trustees finds it is in the best interest of the Village of Lake George to suspend new sanitary sewer connections to the Village's sanitary sewer system for a period of two years except as provided for herein.
From the effective date here, and for a period of two calendar years, there shall be no new connections to the Village of Lake George sanitary sewer system, including but not limited to the Village's sanitary sewer collection system, except as follows:
A. 
Replacement of existing sewer connection laterals shall be permitted upon approval by the Superintendent of Public Works of the Village of Lake George in accordance with Chapter 166 of the Code of the Village of Lake George;
B. 
New sanitary sewer connections for individual single-family residential homes upon approval by the Superintendent of Public Works of the Village of Lake George in accordance with Chapter 166 of the Code of the Village of Lake George;
C. 
New sanitary sewer connections as part of any project approved prior to the effective date of this article. For purposes of this article, "approved" shall mean any project for which a building permit has been issued prior to the effective date of this article, or any project which has received site plan approval by the Village of Lake George Planning Board prior to the effective date of this article; and
D. 
New sanitary sewer connections that may be approved by the Board of Trustees upon recommendation from the Superintendent of Public Works of the Village of Lake George in accordance with Chapter 166 of the Code of the Village of Lake George.
If any clause, sentence, paragraph, subdivision, section, or part of this article or the application thereof to any person, individual, corporation, firm, partnership, entity, or circumstance shall be adjudged by any court of competent jurisdiction to be invalid or unconstitutional, such order of judgment shall not affect, impair or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, section, or part of this article, or in its application to the person, individual, corporation, firm, partnership, entity, or circumstance directly involved in the controversy in which such order or judgment shall be rendered.
This article shall take effect upon filing in the office of the Secretary of State of New York State.
