A Police Department is hereby established in and for the Borough of Baden. The Chief of Police shall be the chief executive of the Police Department. He shall, under the direction of the Mayor, be in charge of the police force and have supervision over its members, in the exercise of their powers, duties and authority.

In the Police Department, the following classifications or ranks are hereby established subordinate to the Chief of Police: Captain, Lieutenant, Sergeant, Corporal and Patrolman. The salary for each classification or rank shall be subject to collective bargaining. However, this amendment was not intended to, nor shall it be construed to, require Borough Council to appoint or assign any individual to any particular classification or rank. Rather, it shall be the sole discretion of Borough Council to either appoint individuals to classifications or ranks, according to law, or, in the alternative, to leave said classifications or ranks vacant, except and only except to the extent that individuals have heretofore been appointed to any classifications or ranks.

Nothing herein contained shall effect the authority of the Mayor to appoint special policemen during emergencies.
